Learning outcomes

The course deals with Italian constitutional law in a diachronic perspective, focusing in particular on the most established constitutional practices in the republican experience. The course aims at providing the students with the basic principles of the discipline and, in general, with the necessary tools to tackle and master the whole juridical phenomenon in the final years of studies and in the development of the future professional activity. In order to achieve this, students will be actively involved: some will produce oral presentations on specific topics of the programme; it will thus be easier to assess the correct learning of the issues discussed, and the appropriate use of legal language. These presentations, if positively evaluated, will be taken into account towards the exam overall mark, with the assignment of “didactic credits”, as explained at the beginning of the course.

Textbooks:

The examination will be based on the following coursebook, to be mastered thoroughly:
• V. ONIDA, M. PEDRAZZA GORLERO (a cura di), Compendio di Diritto Costituzionale, Giuffrè, Milano, 2011.

In addition, the student will be required to know the Constitutional norms, together with the main State, Constitutional and ordinary laws related to the indicated disciplines; these can be found in any of the following collections:
• AA. VV., Leggi fondamentali del diritto pubblico e costituzionale, Giuffrè, Milano, ult. ed.;
• P. COSTANZO, Testi normativi per lo studio del diritto costituzionale italiano ed europeo, Giappichelli, Torino, ult. ed.

Examination Methods

L’esame consta di una prova scritta sotto forma di test a risposta chiusa e multipla, valutato in trentesimi, composto da 20 domande; per ogni errore o risposta non data vengono sottratti 2 punti; l’esame dura 30 minuti e si considera superato se si ottengono almeno 18 trentesimi.
Durante il corso verrà tuttavia effettuata una prova intermedia di accertamento del profitto, facoltativa per gli studenti, consistente in un test a risposta multipla avente ad oggetto il programma svolto a lezione fino a quel momento. Il superamento di tale prova (almeno 18/30), valutata con gli stessi criteri stabiliti per l’esame e sopra indicati, consentirà di accedere ad un secondo e conclusivo accertamento del profitto, consistente in un altro test a risposta multipla, contenente domande aventi comunque ad oggetto l’intero programma del corso e anch’esso valutato secondo i criteri sopra esposti, che si potrà sostenere a partire dalla prima sessione d’esami utile (gennaio-febbraio 2014) e per tutte le rimanenti sessioni dell’anno accademico 2013-2014, ma non oltre.
Il voto finale dell’esame, se quest’ultimo verrà superato attraverso due distinte prove di valutazione, risulterà dalla media aritmetica dei voti conseguiti in entrambe. I candidati che, avendo superato la prova intermedia, volessero rinunciare al voto positivo in essa conseguito, potranno comunque farlo, dichiarando espressamente la propria rinuncia il giorno dell’esame, al momento dell’appello nominale e della contestuale identificazione personale.
Gli studenti che non supereranno la prova intermedia, quelli che rinunceranno al voto positivo in essa conseguito e quelli assenti al suo svolgimento, non potranno suddividere l’esame in due distinte prove di valutazione e dovranno necessariamente presentarsi a sostenere l’esame, per intero, negli appelli delle sessioni programmate.
