Learning objectives
The aim of the course is the acquisition of the knowledge necessary to critically examine the legal issues concerning the EU immigration and asylum policy, the status of migrants and displaced subjects, as well as their fundamental rights and duties. Even though the main focus will be the European Union legal order, the analysis will be carried out in the light of the intertwining between the national level, on the one hand, and the international law, on the other, with special attention to the European Convention on Human Rights. The course will give a broad overview of migration studies and contemporary challenges within the field, combining legal, a theoretical and a practical approach and covering the role of governmental and intergovernmental institutions (as well as NGOs) in national and international refugee work, considering in particular the problematic issues arisen during the most recent migration crises.
Prerequisites and basic notions
None.
Program
The course will cover the following topics:
- historical evolution of the EU policy on immigration and the different aspects that are influencing the migratory phenomenon in a global perspective;
- relevant provisions of EU Treaties and of the Charter of Fundamental Rights;
- the Control of external borders and the European Visa Policy;
- the freedom of movement for non-EU citizens;
- the Dublin III Regulation and the Common European Asylum System (CEAS);
- reception policies vs refusal of entry policies, even with regard to collective pushbacks;
- the international agreements in the field of immigration;
- the immigration policy and the respect of fundamental and human rights.
Bibliography
Didactic methods
Classes are taught in Italian.
Classes will be organised according to a practice-oriented approach, combining lectures devoted to the study of the basic notions and legal sources regarding the freedom of movement of persons and their family members, with practical seminars that consist in group discussions of case studies and resolution of actual cases inspired by the practice.
The teaching materials used during classes (slides, legal sources, selected case law) and further readings on specific topics will be made available on the University e-learning platform.
Lectures will be recorded and made available to attending students only.
Students who find themselves in particular situations of fragility due to conditions of disability or learning disorders or who find themselves in situations of limited travel due to COVID may agree with the teacher on the use of any supporting materials and/or tools.
Learning assessment procedures
The final exam is oral and covers the whole course’s program.
For attending students, the exam can be prepared on the notes taken and the teaching materials discussed during classes (provided on the University e-learning platform).
Non-attending students shall prepare the exam on the textbooks indicated in the “Bibliography (Leganto)” section.
Erasmus students can choose to take the oral exam
- in Italian, according to the same course syllabus and examination methods provided for Italian students;
- in English, according to a course syllabus and examination methods to be agreed with the professor.
Evaluation criteria
The exam is aimed at assessing:
- the acquired knowledge and the ability of linking different topics together;
- the legal reasoning regarding the specific law field on which the course focuses;
- language and legal terminology skills;
- analytical and arguing abilities.
Criteria for the composition of the final grade
The final mark will be expressed in thirtieths and will refer to the oral test as a whole.
Exam language
