Learning outcomes

The course explores the impact of new technologies progress on Constitutional law.
The technological evolution seems to challenge some of the distinguishing features of State, namely ‘sovereignty, territory and people’: on one hand, individuals claim new rights, but in doing so, they significantly affect the system of the sources of law, and therefore the never ending tension between Parliament and (national, supranational and international) Courts, between the circuit of political representation and the judicial protection of rights; on the other hand, individuals themselves risk to suffer a lack of protection because of the power of web giants, which operate on a global and virtual market appearing immune from some of the traditional legal boundaries provided by States for protecting individual rights.
The aim of the course is helping students to acquire knowledge necessary in order to address these issues both from a theoretical and practical perspective. Work in groups and written assignments based on Problem Based Solving (PBS) methods will provide students with the ability to assess the implications of the regulatory framework, develop appropriate reasoning and terminology, and formulate independent judgments. The teaching method is aimed at improving continuous learning skills.

Program

The course will consist of two parts:

A) remote session (6 hours): fundamental principles of constitutional law (sovereignty, constitution, sources of law, judicial protection of rights).

B) person session (30 hours):
- Technology and legislative discretion
- Medically Assisted Reproduction and Assisted Death
- Algorithms and judicial decision-making
- Information, freedom of expression and social media
- Privacy and data protection
- Health, enviroment and sustainable development

Examination Methods

ERASMUS students are requested to contact the teacher at the beginning of the course in order to properly plan their study. The exam is held in Italian.
