The course aims to analyze the complex profiles of meddling amongst the principles and the rules provided for by the Welfare Officer Deontology Code and the several criminal institutes – either substantive or procedural – able to be relevant during the ordinary carrying out of this profession. The final target consists of providing for the legal knowledge necessary to a critical approach to the professional deontology and able to orient the choices of conduct of the welfare officer with reference to the sensible relationship with the mandatory reasons of criminal investigation and protection.

The Theory Phase, which is assigned to the systematic framing and the close examination of the static and dynamic legal institutes comprised therein, shall be followed by the Training Phase inside which certain advisable case law investigations shall be displayed together with interactive discussions on cases submitted to the attention of the students.

The Welfare Officer Deontology Code: nature; function; contents; relationship with the criminal rules, both substantive and procedural. Meddling of substantive criminal law: I) general section: basics of crime’s general theory; complicity of crimes; complicity of people to the crime; attempt; uninterrupted crime; omission crime; subjective qualification of the welfare officer ant its influence on the applicable rules; II) special section: the main typical crimes of the welfare officer; in particular, the breach of professional secret. Meddling of procedural criminal law: I) basics of procedural criminal law: «fair» criminal trial; fundamental guarantees; subjects; procedure and trial: from the crime information to the judgment; II) problematic issues of the welfare officer’s activity: obligation of reporting (content, limits, breach, relationship with the professional secret); opposable secret in case of evidence, opposable secret in case of distresses.
