Learning outcomes
The first part of the course focuses on the main features of the process of harmonization of private law in Europe. The study will take into account both the EU law in this field and the national provisions implementing it.
On the basis of skills and knowledge acquired in the first part of the course, the second part will focus on some of the most remarkable achievements of the process of harmonization of private law in Europe, with particular regard to issues connected to the law of contracts, torts and the carrying out of business activities.
Program
I module - Harmonization of private law in Europe: A general overview
Instruments and measures for harmonization. Influence of EU law on national private law. Consumer contract law / Unfair contract terms / PECL / Acquis Principles / DCFR.
II module - Harmonization of European Patrimonial Law
Consumer sales, unfair commercial practices, tort law and liability for defective products .
