IUS/08 - CONSTITUTIONAL LAW

Learning outcomes

The course aims, firstly, to give students the basic tools of constitutional legal methodology and the knowledge needed to analyse and interpret the Italian Constitution. Secondly, to develop critical thinking on events related to constitutional law by reading and discussing articles in the daily press. It finally aims to convey fundamental notions on a citizen’s rights and duties by studying the form of Italian government and public decision-making.

Program

Law and judicial power. Sources of law (basic notions, sources list and conflict resolution). The State. The Republican Constitution: historical origins, fundamental principles and characteristics. Citizen’s rights and obligations. The Parliament. The Government. The President of the Republic. The Constitutional Court. Regional and local authorities.

Examination Methods

L’esame si svolgerà in due fasi. Nella prima fase lo studente dovrà rispondere per iscritto a tre domande con risposta “aperta”. Nella seconda fase lo studente dovrà rispondere ad alcune domande in forma orale. Il risultato della parte scritta, che concorrerà a determinare il voto finale, non impedisce l’accesso all’orale (art. 12, comma 3, del regolamento didattico dei corsi di studio afferenti al Collegio di Giurisprudenza).
Per gli studenti frequentanti, è prevista la possibilità di svolgere una prova scritta facoltativa nel mese di dicembre, dopo la conclusione del corso. Tale prova consisterà in una serie di domande a risposta “aperta”, riguardanti in prevalenza gli argomenti trattati durante il corso. Gli studenti che abbiano superato tale prova dovranno sostenere successivamente, in uno degli appelli previsti dal calendario accademico, un esame orale sulla parte rimanente del programma. Il voto finale sarà determinato dal risultato della prova scritta facoltativa e dal risultato della prova orale.
