Learning outcomes
The course has these educational goals: - ability to analyse and understand the complexity of law and its fundamental logic; - ability to investigate and understand the highlights of the evolution of the main philosophical and methodological schools oriented to explain the legal dimension of social relationships; -·ability to set up legal questions in written and oral forms, applying concepts and categories of the general theory of law and using correct modalities of reasoning and argumentation, an appropriate and specialized vocabulary, a formulation of independent judgments on real cases, a method allowing constant learning and updating of knowledge.
Program
The course will be opened by a very general reflection: moving from the pre-comprehension of law whose are provided also people uneducated in any legal theory, the lectures will have the task to emphasize the historical dimension of this social phenomenon. Then the attention will be focused on Kelsenian perspective and, finally, on Bruno Leoni’s analyses concerning the legal positivism’s thesis.

Examination Methods
The oral examination, based on suggested bibliography, is oriented to evaluate student’s ability to discuss the topics of the course.
The student must demonstrate:
- knowledge and understanding;
- ability to make judgements;
- communication skills;
- learning skills.
