Learning objectives
The course aims to provide students with the most important principles of the intellectual property law and of the law governing firms in the marketplace. A specific focus will be given to the most relevant regulations for commerce, also at the European and international levels. At the end of the course the students will have acquired the essential tools of the mentioned disciplines and the ability to apply them in both domestic and cross-border entrepreneurial operations.
Prerequisites and basic notions
There are no specific prerequisites for this course.
Program
The program aims to address the relevant legal institutions of industrial and competition law, in order to provide an exhaustive framework of the rules related to business strategies of the company, with reference to competition and trademarks.
The program will focus on the following topics:
- Unfair competition
- Unfair commercial practices
- Trademarks and distinctive signs
- Geographical indications
In addition to the relevant provisions of the Civil Code, the Industrial Property Code and the Consumer Code, as well as the regulation of 'European Union, the reference text is Vanzetti - Di Cataldo, Handbook of Industrial Law, Milan, Giuffrè, 2021, p. 1-371.
Bibliography
Didactic methods
The theoretical explanation will be accompanied by a practical approach to the subject, through the presentation of case studies and the related discussion of legal issues.
Learning assessment procedures
The exam is oral, based on questions about three topics belonging to the program.
Evaluation criteria
The final exam aims to verify:
- the gained knowledge;
- the property of language;
- the ability to analyze and resolve legal issues.
Criteria for the composition of the final grade
The vote is expressed out of thirty.
