Learning objectives

The course is intended to provide the student with the knowledge of the fundamental legal rules governing the processing of personal data in the management of property relations.

At the end of the course, the student will be able to analyse and eleborate on the basic legal notions and rules governing the right to privacy in property relations; to apply them to actual cases; to use the appropriate and specific legal jargon; to adopt correct lines of reasoning and argumentation formulating autonomous judgments.

A) EU Regulation No. 679/2016, A) The EU Regulation No. 679/2016, General Data Protection Regulation (EU GDPR);
B) the notions of "personal data", "processing". Data subject, Data controller, Data processor and the other data actors;
C) Principles relating to processing of personal data, Lawfulness of processing - in particular, consent (requirements and legal relevance of consent)
D) Rights of the data subject - in particular, right to data portability;
E) The accountability model adopted by the GDPR;
F) Private enforcement remedies;
G) The possible configurations of rights involving personal data and the problems of inheritance dynamics (with a focus on so-called digital inheritance);
H) The trade value of personal data and its importance in contractual dynamics
I) The European Strategy for Data and the creation of a single data market, Data sharing and Governance in the Data Governance Act (EU Regulation No. 2022/868); the European Commission's Proposal for a Data Act.

Didactic methods

Frontal lessons combined with discussion of practical cases (Problem based learning method). In any case, active student participation during class is encouraged.
Finally, a space may be devoted to in-depth study in seminar form of specific topics, directly involving students and professionals or experts in the subjects covered by the course

Learning assessment procedures

The assessment of the knowledge required will take place through a single oral discussion.
Attending students are allowed to take a partial written pre-test. Teachers may also arrange with students for in-depth individual or group study of specific topics relevant to the course syllabus (paper and presentation of the work to the class).
For ERASMUS students, the assessment procedures are agreed upon in advance with the teachers.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

The evaluation will take place through the following criteria:
- the depth and breadth of the knowledge acquired;
- the property of language;
- analytical and argumentative ability;
- the capacity for critical reflection.

Criteria for the composition of the final grade

The score is referred to the oral test and the final evaluation is expressed in 30ths.
For those students who attend the lessons and take the intermediate test, the final grade also takes into account the result of the test. Any individual or group work developed by students, arranged in agreement with teachers, will also be evaluated.
