Learning objectives

The course is intended to provide the student with the knowledge of the legal institutions governing the prison system, aimed at implementing the individualisation of the sanctioning treatment in accordance with the principle of the re-educational purpose of punishment (Art. 27 paragraph 3 of the Constitution).

At the end of the course, the student will be able to analyse and eleborate on the basic notions and legal rules of the prison system and to apply them to actual cases; to use the appropriate and specific legal jargon; to adopt correct lines of reasoning and argumentation formulating autonomous judgements.

Prerequisites and basic notions

To take the exam of this course it is necessary to have taken the exam of Criminal Law.

Program

During the course the following topics will be covered:
- sources and principles of penitentiary execution
- the subjects of penitentiary administration
- the organization of the surveillance judiciary
- the elements of treatment
- the protection of prisoners' rights
- alternative measures to detention
- order and safety in penal institutions
- surveillance proceedings and complaint proceedings

Didactic methods

The course consists of lectures, totaling 30 hours (equal to 5 CFU), during which principles, rules and institutes of prison law will be analyzed, and a workshop, totaling 12 hours (equal to 1 CFU), devoted to the presentation and classroom discussion of practical cases through the examination of court documents.

Learning assessment procedures

The test is conducted orally.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

The examination aims to verify understanding of the principles, rules and institutions of penitentiary law.

Criteria for the composition of the final grade

The final grade, expressed in thirtieths, refers to the oral examination as a whole.
