Type D and Type F activities
Le attività che consentono l’acquisizione dei crediti riservati alle attività formative a libera scelta dello studente (TAF D) sono le seguenti:
- Un insegnamento previsto nell’elenco delle attività formative TAF D) allegato al piano didattico del corso di laurea in Servizi Giuridici per impese, amministrazioni e no-profit;
- Un insegnamento attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza ;
- Un laboratorio didattico attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
- Un laboratorio didattico attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche;
- Un insegnamento previsto dall’Offerta Formativa di Ateneo, non impartito nell’ambito dei corsi di studi afferenti al Collegio di Giurisprudenza: il riconoscimento dei crediti acquisiti sarà subordinato alla preventiva presentazione di coerenti programmi formativi valutati dalla Commissione istruttoria per la didattica e approvati dal Collegio didattico.
- Attività formative organizzate dai singoli docenti del Collegio di Giurisprudenza o del Dipartimento di Scienze Giuridiche: previa approvazione del Collegio ad esse verrà attribuito, dopo un’apposita verifica, un credito per ogni 6 ore di frequenza obbligatoria;
- Attività formative che implicano la partecipazione a convegni o seminari organizzati sotto il “logo” del Dipartimento di Scienze Giuridiche o dell’Ateneo: devono essere preventivamente approvate dal Collegio di Giurisprudenza indicando un docente di riferimento del Collegio di Giurisprudenza ovvero del Dipartimento di Scienze Giuridiche. Un credito per ogni giornata di convegno o di seminario si acquisisce dopo apposita verifica che dimostri l’avvenuta fruizione culturale del tema del convegno o del seminario.
Le attività che consentono l’acquisizione dei crediti riservati alle ulteriori attività formative (TAF F) sono le seguenti:
• Informatica (3 cfu)
• Stage;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche.

Learning objectives
The course is intended to provide the student with the main private law categories through the study of the cases examined by the Roman jurists, as well as through the modern theories grounded on Roman sources.
At the end of the course, the student will be able to elaborate on legal issues, in both written and oral forms, developing proper reasoning and argumentation, using an appropriate and specific vocabulary, reaching independent judgement on actual cases, adopting a method based on continuous learning and knowledge updating.
Prerequisites and basic notions
No precondition is required.
Program
The course aims at providing the students with the main private law categories through the study of the cases examined by the Roman jurists, as well as through the modern theories grounded on Roman sources. In the view of this goal, one will never ignore the Italian legal rules in force, both included in statutes and deriving from judgments. The lectures will focus on substantial and procedural Roman law; they will explain the elementary discipline of the institutes created by the Roman scientia iuris as well as they will describe the conceptual and technical equipment which nowadays represents a fundamental device for interpreting positive law. The course also aims to encourage students to consider specific legal issues: students should become familiar with the methodological tools needed to apply theoretical knowledge to private law issues.
Reading a full and updated civil code is strongly recommended.

ERASMUS students are kindly requested to contact the Professor at the beginning of the course, in order to arrange the program and the method of the examination.

Didactic methods
Given that the aim of the course is to provide institutional preparation, the teaching method aims at promoting learning through frontal lessons that expose the institutions taking into account their inseparable logical and systematic correlation.
In line with the expected learning outcomes, the approach to some practical cases as final moments of the analysis will not be neglected.
The course combines 30 hours of Direct lecturing (supported by the use of PowerPoint presentations) with 12 hour of Workshop teaching dedicated to introducing and/or reviewing the main topics of study and to exercising students according to the Problem Based Solving (PBS) method.
All the lectures involve the active participation of the students.
Direct lecturing (5 CFU, 30 hours):

Workshop teaching (1 workshop CFU, 12 hours):
- Concept maps on the main topics of study (sources, trial, rights in rem, legal act)
- team work to solve case studies on contracts
- self-assessment tests
Any conferences and/or seminars of interest for the topics dealt with, tutoring activities and optional workshops related to the course will be reported from time to time during the lectures.
Learning assessment procedures
The examination will take place for all – attending and non-attending students – both in written form (with the submission of five open questions to which the student must answer in the total maximum time of thirty minutes), and by interview, in which, after a brief illustration and commentary on the written test, the knowledge of the program will be further examined.
In determining the final mark, written and oral tests have equal importance.
For ERASMUS students, the exam will consist - at the student’s discretion and in agreement with the teacher - of an oral interview or a written paper, in Italian or English, on the part of the programme agreed in advance between the student and the teacher.
Evaluation criteria
The exam’s goal is to test the program knowledge, having regard to the student’s ability to develop a critical reasoning on specific legal issues.
The evaluation criteria are as follow:
- acquisition of knowledge;
- acquisition of critical reasoning skills;
- acquisition of analytical capacity and arguing ability.
Criteria for the composition of the final grade
The final evaluation is expressed in thirtieths (30/30). The evaluation between 18 and 20 corresponds to a sufficient, yet low and basic, knowledge of the contents; the evaluation between 20 and 25 shows a more than sufficient/discreet knowledge of the contents; the evaluation between 25 and 29 shows a good or very good knowledge of the contents together with commendable critical skills. The evaluation between 30 and 30 cum laude corresponds to a very good or excellent knowledge together with high critical, analytical and connection skills.
Exam language
Italiano. Gli studenti ERASMUS potranno scegliere se sostenere la prova in italiano o in inglese, previo accordo con il Docente.
