Learning outcomes

The reflection on the legal organization of inter-subjective relationships represents the background of this academic discipline. Within such a frame, Philosophy of Law aims at investigating what founds and justifies choices taken by the legislator, by judges, by jurists, or by citizens, and trying to evaluate their reasons and their coherence and consistency with the search for a recta ratio.
By analysing and critically evaluating the main doctrines of modernity , the course intends, firstly, to underline the limits of both a normativistic and formalistic approach to jurisprudence and, secondly, to rediscover the worth of a classical, procedural and dialectic, approach to legal experience.
