Learning outcomes

The course aims at highlighting the Roman law of contracts with its main features and at enlightening all the continuities and discontinuities existing between past and present. Each lecture will focus on the casuistic approach used by Roman jurists (by discussing concrete and specific questions attested by our sources), as well as on the so-called ‘actional perspective’ (by suggesting a remedial approach rather than an approach grounded on substantive legal positions).

L’esame si svolge per tutti – frequentanti e non frequentanti – mediante accertamento in forma orale, preceduto da una breve verifica in forma scritta concernente i primi due saggi contenuti nel volume Scambio e gratuità. Confini e contenuti dell’area contrattuale.
