Learning objectives

The course aims at providing the necessary conceptual, regulatory and methodological tools for analysing and understanding the main social and labour law issues and regulations at the international and EU level. The purpose of the course is to put students in the condition to comprehend how the International Labour Organisation (ILO) and the European Union (EU) operate with regard to labour protections and their ability to understand how different levels of regulations interact in multilevel systems, having particular regard for the role of the Court of Justice of the European Union (CJEU).

Program

After a presentation of the multilevel structure of labour rules, the course will focus on the historical evolution of EU social policy from the Rome Treaty to the entry into force of the Lisbon Treaty in December 2009. The first part of the course will focus on the study of the functioning of sources in EU law, discounting the binding nature of the Charter of Fundamental Rights, with particular regard to the distinction between hard and soft sources and the functioning of the EU social dialogue. The course will continue by delving into the traditional topics of EU social law: free movement of workers, employment policies, atypical jobs, discrimination, working time, company crises, health and safety in the workplace. The directives adopted on the basis of Title V of the TFEU will also be studied in depth. The study of the main rulings of the Court of Justice of the European Union is an integral part of the course. The key topic chosen for the academic year 2023-2024 is the European Pillar of Social Rights.

Didactic methods

For A.Y. 23-24 the lectures will be delivered in presence. The teaching methods consist of frontal lessons dedicated to the transmission of the basic notions of the social and labour dimension of EU law, of the key categories and of the fundamental applicative tools; in addition to this, there are exercises with the support of particularly significant case law pronouncements of the supranational Courts, in particular of the EU Court of Justice, useful for the implementation of the theoretical knowledge acquired. In addition, also thanks to the University's e-learning platform, specific readings are proposed to update a discipline that is the subject of continuous attention by the EU legislator, as well as in itinere self-assessment activities of learning.
Recorded lectures and teaching materials will be made available to students on the teaching MOODLE platform.

Learning assessment procedures

In A.Y. 23-24, the examination will be conducted in two stages: a written test dedicated to the fundamentals of the course will be followed by the presentation of a project work dedicated to a specific case dealt with in a group or individually by each student intending to take the examination. Specific procedures for writing and presenting the project work will be shared in the classroom by the lecturer during a dedicated lecture. ERASMUS students are requested to contact the lecturer at the beginning of the courses in order to agree together on the teaching and testing arrangements.

Evaluation criteria

The written test and project work will be assessed taking into consideration
- the correctness of the answer given to the questions posed;
- the depth and breadth of knowledge gained;
- the property of language;
- the ability to systemically link knowledge;
- analytical and argumentative skills.

Criteria for the composition of the final grade

The written test weighs 50% of the overall grade expressed in thirtieths.
The PW written and oral test weighs 50% of the overall grade expressed in thirtieths.
The award of honors is linked to the following assessment of the examination: complete autonomy of the student, complete control of the discipline, particularly appreciable critical and argumentative ability of the student.
