Learning objectives

The course aims at providing the necessary conceptual, juridical, methodological and cultural bases for understanding the system of constitutional law dealing with media and journalism. The purpose of the course is to make students capable of grasping the legal framework governing the various media and understanding the juridical and cultural impact that the development of new media bear on journalism. At the end of the course students shall have the ability to correctly identify the legal framework dealing with the different media in order to solve legal issues arising out of or in connection with journalism activity.

Prerequisites and basic notions

Knowledge Institutions in Constitutional Law.

Program

The course analyzes the Constitutional Law of Information as dissemination of news and reviews performed by the modern agora and the journalism as essential freedom for constitutional democracy.
The course focuses on the Freedom of the press as fundamental Freedom guaranteed by the Constitution. As such, courts and legislative bodies have been hesitant to impinge on that freedom. In fact, the course analyzes the Freedom of Information Act and the relationship between economic freedom and journalism.
The course will examine the journalism and the multiplication of influences of media in contemporary society and the latest technological developments, especially the Internet developments.
The course will explore the legal issues of the proliferation of new media and legal nature of journalism and journalists.
Because "media" today includes the ever-expanding internet, the course will address how traditional legal concepts have been adapted to fit the reality of today's internet.
Areas that come under media law are broadcast television, radio, print media such as newspaper, and, most recently, the internet through things like social media or digital media. Not all media follows the same rules and regulations under the law. Broadcast media, for example, is subject to numerous regulations, while the internet has fewer regulations concerning freedom of speech or invasion of privacy.
