Learning objectives

The course aims at highlighting Roman criminal law (as far as substance and procedure are concerned), with its main features and at enlightening all the continuities and discontinuities existing between past and present. At the end of the course, students will develop the ability to formulate, in an autonomous and critical way, judgements and elaborated arguments on the main legal questions dealt with in class.

Prerequisites and basic notions

Roman Law Institution is the preparatory exam for this course.

Program

General part:
- ‘Ius publicum’ and criminal law (4 h.);
- Monarchy and Republic: civic guaranties (4 h.);
- Criminal comitial trials (8 h.);
- The trial of ‘quaestiones’ and the administration of justice during the Principate (8 h.).
Special part:
- in-depth study on Kings and Cultural Memory; Blood Mixing and Vocation to Empire; ‘Sacri’ to ‘divi parentum’; The Repression of Homicide; At the dawn of Senate (12 h.).
Reflection on these topics from a historical perspective promotes the training of jurists capable of benefiting the institutions of the legal system, in terms of greater effectiveness, liability and transparency (GOAL 16), gender equality (GOAL 5) and the reduction of inequality (GOAL 10).
The students attending the course may limit their study to the contents and materials of the lessons.
ERASMUS students are kindly requested to contact the teachers at the beginning of the course, in order to agree the exam’s program. The exam will consist in the discussion of a written essay (in Italian or in English) concerning a specific topic agreed with the teachers.

Didactic methods

Alongside the traditional frontal modality, the lessons aim to stimulate the legal reasoning capacity of students, through their active participation, especially by soliciting the analysis and discussion of the legal issues submitted to them. Any conferences and / or seminars of particular interest for the topics covered will be reported from time to time by the teachers during the lessons.
The didactic material uploaded on the e-learning platform will be available to students.
The video recordings of the course lessons will be made available exclusively to the following categories of students, who are kindly invited to contact the teachers:
- students with disabilities, invalidity or DSA, following communication to the teacher by the Inclusion and Accessibility Unit;
- students participating in the PA 110 e lode training project;
- Panopto for workers.

Learning assessment procedures

After a preliminary written test (three open questions; maximum 45 minutes), the exam will consist in a further oral interview.
By agreement with the teachers, students attending the course could present a written essay on a specific topic to the class.
For ERASMUS students the exam will consist on a written paper, in Italian or English, on the part of the programme agreed in advance between the student and the teacher.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

The exam's goal is to test the program knowledge, having regard to the student’s ability to develop a critical reasoning on specific legal issues.

Criteria for the composition of the final grade

The final evaluation shall be expressed in thirtieths (30/30). The final evaluation is expressed in thirtieths (30/30). The evaluation between 18 and 20 corresponds to a sufficient, yet low and basic, knowledge of the contents; the evaluation between 20 and 25 shows a more than sufficient / discreet knowledge of the contents; the evaluation between 25 and 29 shows a good or very good knowledge of the contents together with commendable critical skills. The evaluation between 30 and 30 cum laude corresponds to a very good or excellent knowledge together with high critical, analytical and connection skills.

Exam language

Italiano. For ERASMUS students: written paper in English.
