Laurea magistrale a ciclo unico in Giurisprudenza - Enrollment from 2025/2026

Le attività che consentono l’acquisizione dei crediti riservati alle attività formative a libera scelta dello studente (TAF D) sono le seguenti:
• Un insegnamento previsto nell’elenco delle attività formative (TAF D) allegato al piano didattico del corso di laurea Magistrale in Giurisprudenza;
• Un insegnamento attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche;
• Un insegnamento previsto dall’Offerta Formativa di Ateneo, non impartito nell’ambito dei corsi di studi afferenti al Collegio di Giurisprudenza: il riconoscimento dei crediti acquisiti sarà subordinato alla preventiva presentazione di coerenti programmi formativi valutati dalla Commissione istruttoria per la didattica e approvati dal Collegio didattico.
• Attività formative organizzate dai singoli docenti del Collegio di Giurisprudenza o del Dipartimento di Scienze Giuridiche: previa approvazione del Collegio ad esse verrà attribuito, dopo un’apposita verifica, un credito per ogni 6 ore di frequenza obbligatoria;
• Attività formative che implicano la partecipazione a convegni o seminari organizzati sotto il “logo” del Dipartimento di Scienze Giuridiche o dell’Ateneo: devono essere preventivamente approvate dal Collegio di Giurisprudenza indicando un docente di riferimento del Collegio di Giurisprudenza ovvero del Dipartimento di Scienze Giuridiche. Un credito per ogni giornata di convegno o di seminario si acquisisce dopo apposita verifica che dimostri l’avvenuta fruizione culturale del tema del convegno o del seminario.

Le attività che consentono l’acquisizione dei crediti riservati alle ulteriori attività formative (TAF F) sono le seguenti:
• Informatica (3 cfu)
• Stage;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche.

Learning objectives

The teaching has the objective of acquiring: - the ability to apply legal reasoning to the rules and institutions governing the functioning of banking and financial activities. The aim is to develop the ability to understand and analyze the internal and supranational sources of laws regulating banking and financial activities in relation to the protection of the various public and private interests at stake, referring in particular also to citizens, users and consumers; - the ability to frame and set legal questions pertaining to the main issues of the subject with reference to both the organization of institutions and to regulatory action, with an understanding of the main logics underlying the relationship between banking and financial law and economics, and with the acquisition of an appropriate and specific disciplinary lexicon, the ability to formulate autonomous judgments on concrete cases, a method that allows continuous learning and updating of knowledge.

Prerequisites and basic notions

No specific prior knowledge is required.

Program

The course intends to illustrate some of the essential elements of banking law and financial markets. They include: - The notion of banking intermediation and the related special discipline between EU law and national law. - Regulatory sources of international, EU and national law - EU and national supervisory authorities. Various types and instruments of public supervision. - The European Banking Authority (EBA) and the European Banking Union - The requirements for obtaining authorization to carry out financial intermediation activities - The rules to be observed in the provision of financial intermediation services (capital, organizational and conduct requirements ). - The protection of users/consumers - The regulation of the main contracts - The liability of intermediaries

Didactic methods

The course lasts 36 hours (6 CFU) and will take place with the support of slides and study materials previously indicated (eg legislation and jurisprudence of the European Union). Students will be invited to participate in the discussion on the various topics introduced and explained by the teacher, also on the basis of the previous reading of the aforementioned study materials.

Learning assessment procedures

The exam has the objective of verifying the level of achievement of the training objectives indicated above. The exam will be in written form (60 minutes) on three / four topics / questions.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

For attending students, the final grade will be awarded based on the following three criteria. 1) in answering the questions, the ability to demonstrate: a) knowledge of the relevant legislation and jurisprudence and the related doctrinal analysis; b) the effective understanding of the notions, general principles and relevant discipline, as well as the underlying 'logic' of the subject learned during the lessons and from the study of the texts (e.g., which objectives are pursued by the legislator, which interests what are the underlying general legal principles, what is the role of the various institutional actors, what are the macro-changes that have taken place in the legal framework). 2) in answering the questions, the use of the correct legal terminology. 3) the degree of participation of the student in the discussions held during the lessons. Non-attending students, the exam consists of three / four questions against which the student will be assessed on the basis of two criteria: 1) the ability to demonstrate: a) knowledge of the relevant legislation and jurisprudence and of the related doctrinal analysis; b) the effective understanding of the notions, of the general principles, of the relevant discipline, as well as of the underlying 'logic' of the subject learned from the study of the texts (e.g., which objectives are pursued by the legislator, which public interests are at stake , what are the underlying general legal principles, what is the role of the various institutional actors, what are the macro-changes that have taken place in the legal framework). 2) The use of correct legal terminology.
