IUS/20 - PHILOSOPHY OF LAW
Period
1° periodo di lezioni dal Oct 3, 2016 al Dec 16, 2016.
Learning outcomes
The purpose of this course is to help students to become familiar with the main legal-philosophical categories, in order to form a sound conceptual and terminological background for the comprehension of legal experience.
The educational pathways will be developed with regard to some key-questions in the philosophy of law, from the ancient Greek thought to the modern legal positivism and its crisis: in the background of this itinerary there is the notion of justice in its different articulations and accents.
The overall goal is to help students to reflect on the origin and on the principles of legal experience, and to critically confront with the limits of normativistic and formalistic approaches.
Program
The course focuses on three issues:
- Justice and legal norm: the relationship between these notions will be analysed by means of some classical texts of 20th century legal positivism
- Justice and political society: the social dimension of justice and its anthropological roots will be analysed by means of a classical philosophical text
- Justice and legal case: the relationship will be analysed moving from a contemporary inquiry about the origin of law.
Examination Methods
The final examination is oral.
Erasmus students are invited to personally contact the lecturer at the beginning of the course.
