Learning objectives
The course aims at analysing the scope of jurisdictional control of public bodies decisions, by providing students with the main tools to understand both the theoretical and practical problems arising out of judicial review. The origins and development of our administrative courts review will be hence examined with special attention on jurisdiction problems, remedies, hearings, evidence and enforceability of courts decisions. Case-study will complement frontal lectures. The course will focus on the study of particularly interesting cases, with students discussing them.
Prerequisites and basic notions
The study of judicial review presupposes knowledge of the concepts and notions dealt with in the course of Administrative Law 2. It is therefore recommended to have passed the Administrative Law 2 exam.

- Development and evolution of the Italian system of administrative justice.
- The increasing use of ADRs in administrative litigation.
- Judicial review: actions before the administrative courts.
- Judicial review: parties and standing.
- The territorial jurisdiction of the administrative courts.
- First-instance court proceedings. Interim relief.
- The court's decision and its effects.
- Appeal to the Council of State.

Didactic methods
The teaching methods consist of lectures (supported by ppt presentations) devoted to an in-depth study of the basic notions of the administrative proceedings of first instance and the main institutions of the appeal proceedings before the Council of State. The lectures will be supplemented by teaching material uploaded onto the e-learning platform.
Video recordings of the lectures will be available on request for authorised students.
Learning assessment procedures
The exam consists of an oral test aimed at ascertaining a critical knowledge of the fundamental features of administrative court procedure.
Students who have attended at least 75% of the lectures may take the oral examination in the following manner: a first part may concern a subject of their choice (agreed with the lecturer) relating to the first instance proceedings, to be developed in a short written paper; a second part will focus on the knowledge of the institutes of the judgement of appeal developed during the lectures.
Non-attending students may prepare for the exam on the chapters of the textbook indicated in the Bibliography section.
Evaluation criteria
The exam aims to verify knowledge of the fundamentals of administrative courts procedural law and the ability to identify – based on logically correct reasoning - solutions, to be set out using technically adequate vocabulary.
The assessment will take into account the following elements
- depth and breadth of knowledge acquired;
- property of language;
- ability to link knowledge in a systemic form;
- analytical and argumentative capacity.
