Learning objectives

The course aims at providing students with an in-depth knowledge of the most common special contracts (including the atypical ones) – regulated in the civil code and other laws – that are relevant to the contemporary business, in the context of domestic and international trade. Students shall acquire the ability to solve the legal issues examined during the course and to autonomously formulate in-depth judgements and arguments, both in written and oral form, as well as to critically adapt the solutions developed to different contexts.

Prerequisites and basic notions

A prerequisite for attending the course is knowledge of the basic notions of private law, with particular regard to the law of obligations and contracts in general.

Program

The course aims to offer students the opportunity to further consolidate and deepen the topics of private property law, through the analysis and participatory solution of current cases, which will be examined according to a perspective that enhances the practical application of the theoretical knowledge learned in the institutional courses. The course, included in the training program "Business and global markets", focuses in particular on some of the most common typical contracts in business practice and is divided into the guided analysis of some tracks, proposed by the teachers, in order to stimulate reflection on controversial aspects or, in any case, of significant practical impact, giving students the opportunity to immerse themselves in the continuous comparison with the doctrine and jurisprudence that characterizes the activity of every legal operator. Contracts represent the main legal instrument available to private individuals, including entrepreneurs, to govern their own patrimonial sphere. A greater awareness of the potential of this instrument, in its manifestations typified by law and market practice, including international, therefore contributes to achieving the objective of supporting the development of businesses, both directly and through the training of professionals who cooperate with the entrepreneur (GOAL 8)

Didactic methods

The lessons consist of the guided and reasoned solution of current cases on the subject of typical contract law. Tracks that retrace relevant issues, often the subject of debate, addressed by practitioners and scholars will be discussed with the participating students. A space of the course will be dedicated to the in-depth study in seminar form of specific topics, directly involving professionals and other experts in the subjects covered. For ERASMUS students, the program must be agreed with the teacher at the beginning of the lessons.

Learning assessment procedures

The exam consists of an oral test. Students who regularly attend the course will have the option of taking a pre-assessment test. The teacher may also agree with the students on individual or group in-depth studies of specific topics related to the course program (thesis and presentation of the work to the class). For ERASMUS students, the assessment methods must be agreed with the teacher at the beginning of the lessons

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

The evaluation will be based on the following criteria:
- the depth and breadth of the knowledge acquired;
- the command of language;
- the analytical and argumentative capacity;
- the capacity for critical reflection.

Criteria for the composition of the final grade

The exam result is given by the evaluation, expressed in 30, of the oral test taken by the student. For students who regularly attend, the result of the pre-assessment test (optional) and the evaluation of the paper and the presentation of individual or group work (if applicable) may also contribute to this result.
