Learning objectives

The course provides students with concepts and tools for understanding a particular area of constitutional law: the judiciary. Students will be able to analyze and interpret the norms contained within Title IV, Part Il of the Constitution, and begin to develop autonomy towards interpreting and critically reflecting upon various aspects of the Italian judicial system.

The following topics will be covered during the course: - introductory notions: jurisdiction and judge - the ordinary judiciary: organization and functions - special judiciaries: types and functions - the judicial system - guarantees of autonomy and independence of the judiciary and the concept of impartiality - the CSM (Higher Council of the Judiciary) - the Minister of Justice - the judiciary and other powers of the State - the political rights of magistrates - due process

36 hours (6 CFU) of lectures

Learning assessment procedures

The exam is oral and covers the entire exam program. Language: Italian. For ERASMUS students, the exam will be oral and in Italian, based on a different program to be agreed upon with the instructor.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

The exam is designed to verify, in addition to the acquisition of the required knowledge, that students have developed sufficient analytical skills. Specifically, the test assesses: - the depth and breadth of knowledge acquired; - linguistic competence; - the ability to systematically connect knowledge; - analytical and argumentative skills.
