Learning objectives
The course aims at dealing with and analysing the juvenile criminal justice system and the provisions that protects the rights of minors and their best interest, especially in a family setting. The course will offer to the students the knowledge (both from a substantive and a procedural perspective) needed to operate in this field and to be able to critically tackle issues and cases, also in a European and international context.
Prerequisites and basic notions
It is mandatory to have a basic Knowledge of Criminal Law.
Program
The course is divided into 4 parts:
1st Part: Family violence and juvenile crime (Goals 5,10,16)
- Juvenile distress, juvenile delinquency
- Youth gangs
- Online juvenile deviance
2nd Part: The minor perpetrator and victim of crimes
- Imputability and investigations into the minor's personality
- Child pornography, child prostitution and sexual assaults
- Deepnude, sexting and revenge porn
- Bullying and cyberbullying
3rd Part: The juvenile penal system
- The juvenile court
- The juvenile penal process
- The institutes for the early definition of criminal proceedings
- Sanctioning system and penal institutions for minors
- Alternative measures to detention
- Restorative justice and penal mediation
4th Part: Crimes in the family context
- Violation of family assistance obligations
- Abuse of means of correction
- Mistreatment against family members or cohabitants

Didactic methods
Language of teaching for this course is Italian. The literature and auxiliary material are basically in Italian.
For students attending classes, the course will be mainly based on lectures and cooperative learning activities. Workshops, seminars about specific topics or case studies could be organized during the course. Some lectures or seminars could be also delivered by distinguished Visiting Professors. The online registration to the University e-learning platform will provide students with a source of reference, bibliography, scientific papers and selected case-law.
The professor will provide support to students non-attending classes during the office hours (see the Law Department webpage).
Students not-attending classes and ERASMUS students are kindly requested to contact the Professor at the beginning of the course, in order to agree on the exam’s program and the books and material to study.
Learning assessment procedures
The final exam consists of an oral exam. Students attending classes have the possibility to divide the exam into two parts (written part: 50% of the final note; oral part: 50% of the final note).
Evaluation criteria
The final exam aims at verifying:
• The level of achievement of the learning outcomes previously identifies
• The linguistic accuracy
• The argumentative, reasoning and problem-solving skills
• The ability to connect systematically the knowledge achieved
Students attending classes and Erasmus students have the possibility to write a short paper on specific topics, upon agreement with the professor. The paper will be discussed during the oral examination and will be part of the final exam.
Criteria for the composition of the final grade
Grades are awarded on a scale from 18 to 30, where 30 is the highest grade and 18 is the lowest grade to pass the exam. In case of an excellent knowledge, a high level of linguistic accuracy and an argumentative, reasoning and problem-solving capacity the candidate may earn the highest grade with “cum laude” honor.
