IUS/13 - INTERNATIONAL LAW

Learning outcomes

The object of this course is to offer a theoretical and practical introduction to the main legal issues arising from the globalization of the world economy. The course examines both the wider issues of governance of the world economy and the specific legal issues arising from various types of international business transactions.

The first part of the course is designed to provide students with the conceptual tools to understand the legal foundations of the contemporary world economy. It examines international "subjects" (States, international organizations and private actors) and sources (customs, treaties and their implementation in national legal orders).

The second part of the course examines the roles of international economic institutions in global and regional contexts. A particular emphasis is placed on the law and institutions of the WTO. A variety of trade-related topics will be discussed, and the functioning of the WTO's dispute resolution system will be discussed. The course will also cover basic principles of international investment law and the settlement of disputes under bilateral investment treaties.

Program

Lectures will incorporate class discussions on specific subjects. Concrete cases will also be discussed on the basis of materials distributed during the course. Topics will include:

- The history and evolution of the world trading system since 1947
- The WTO's institutions
- The WTO Agreements
- Resolution of international trade disputes
- Reconciling trade objectives and public interest objectives
- International investment law

Examination Methods

Students that attend the course will take a written exam. They can prepare on the basis of their class notes, distributed materials, and the following book: Andreas Lowenfeld, International Economic Law, Second Edition, Oxford University Press, Oxford, 2008, chapters 3 to 7 and 9 to 17.

Students that do not attend the course will take an oral examination on the basis of the following book: Andreas Lowenfeld, International Economic Law, Second Edition, Oxford University Press, Oxford, 2008, chapters 3 to 7 and 9 to 17.

Internships

The curriculum of the three-year degree courses (CdL) and master's degree courses (CdLM) in the economics area includes an internship as a compulsory training activity. Indeed, the internship is considered an appropriate tool for acquiring professional skills and abilities and for facilitating the choice of a future professional outlet that aligns with one's expectations, aptitudes, and aspirations. The student can acquire further competencies and interpersonal skills through practical experience in a work environment.
