Laurea magistrale in Governance dell'emergenza - Enrollment from 2025/2026• Un insegnamento attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche;
• Un insegnamento previsto dall’Offerta Formativa di Ateneo, non impartito nell’ambito dei corsi di studi afferenti al Dipartimento di Scienze Giuridiche: il riconoscimento dei crediti acquisiti sarà subordinato alla preventiva presentazione di coerenti programmi formativi valutati e approvati dal Collegio didattico.
• Attività formative organizzate dai singoli docenti del Collegio didattico o del Dipartimento di Scienze Giuridiche: previa approvazione del Collegio;
• Attività formative che implicano la partecipazione a convegni o seminari organizzati sotto il “logo” del Dipartimento di Scienze Giuridiche o dell’Ateneo: devono essere preventivamente approvate dal Collegio didattico indicando un docente di riferimento del Collegio didattico ovvero del Dipartimento di Scienze Giuridiche.
• Attività formative che implicano la partecipazione a convegni o seminari organizzati prive del “logo” del Dipartimento di Scienze Giuridiche o dell’Ateneo: devono essere approvate dal Collegio didattico indicando un docente di riferimento del Collegio didattico ovvero del Dipartimento di Scienze Giuridiche.

Learning outcomes
The aim of the course is the acquisition of the knowledge necessary to critically examine the legal issues concerning immigration and asylum laws, the status of migrants and displaced subjects, as well as their fundamental rights and duties. The analysis will be carried out in the light of the intertwining between constitutional principles, national case-law and legal constraints arising from European Union law, international law, with special attention to the European Convention on Human Rights. The course will give a broad overview of migration studies and contemporary challenges within the field, combining legal, theoretical and policy approaches and covering the role of governmental and intergovernmental institutions (as well as NGOs) in national and international refugee work.
Program
The course will cover the following topics:
- historical evolution of the EU policy on immigration and the different aspects that are influencing the migratory phenomenon in a global perspective;
- relevant provisions of EU Treaties and of the Charter of Fundamental Rights;
- the Control of external borders and the European Visa Policy;
- the freedom of movement for non-EU citizens;
- the Dublin III Regulation and the Common European Asylum System (CEAS);
- reception policies vs refusal of entry policies;
- the international agreements in the field of immigration;
- the immigration policy and the respect of fundamental and human rights.
TEACHING METHODS
Classes are taught in English.
The teaching will comprise both lectures focused on the study of the basic notions and legal sources regarding European Union law and practical lectures during which the relevant case law will be discussed.
During the lessons the professor will avail herself of powerpoint presentations.
The teaching materials used during the course, to be added to the reference book, will be provided to the students through the University e-learning platform.
BIBLIOGRAPHY
The exam will ascertain their preparation on the topics covered during the lectures and can be prepared on the materials distributed in class and on the e-learning platform.
Attendance (either in class or via Zoom) is therefore highly recommended to prepare the exam.
Erasmus students are required to prepare the same course program as the Italian students.
Examination Methods
Both for Italian and Erasmus students, the exam will be held in English and will be oral.
EXAM ASSESSMENT
The exam is aimed at ascertaining, besides the required preparation, that the student has developed sufficient analytical capacity. In particular, the examination is aimed at assessing:
- the level of the preparation of the student;
- the use of the appropriate legal jargon;
- the ability of connecting the different topics of the programme;
- the analytical capacity.
