Learning objectives

The course will provide, principally starting with two critical macro-sectors of criminal law, the conceptual, methodological and cultural basis to understand and study the categories and the general principles, developing the capacity in using correct and specific technical language. At the end of the course students will be able to understand, on the one hand, the emerging and current criminal phenomena in the technological context (i.e. in particular terrorism, cyber-terrorism, cyber attacks and „cyber-war“) and, on the other side, the criminal offences regarding the public adminstraions, identifiyng the application/leading solutions through the most appropriate reasoning and legal arguments.

Program

Introduction: Serious and transnational crime and criminal law for the administration. 1. General elements of Italian criminal law, from a European perspective. 2. Crimes against public administration: 2.a. General introduction and subjective qualifications (Articles 357 to 360 of the Criminal Code), 2.b. Crimes against public property, crimes against the 'trading' of public functions, crimes against functional duties (Articles 314 to 335-bis of the Criminal Code), 2.c. Individual crimes by private individuals against public administration (Articles 336, 337, 340, 341-bis, 346, 346-bis, 348, 353 to 356, 393-bis of the Criminal Code). 3. Cybercrime and criminal law for the administration: 3.a. Criminal phenomena and emergencies in the technological context (cyber-attacks, cyber-terrorism, data & Internet governance, cybersecurity & data protection), 3.b. Cybercrime and criminal law for the administration (the main cybercrimes, strictly and broadly, against public administration or committed by public officials, including unauthorized access, computer fraud, and unlawful data processing).

Didactic methods

In-person lectures cover all chapters of the program and will focus on individual case studies covered during in-person lectures, using the Problem-Based Solving (PBS) method. All lectures will also be streamed and video-recorded. In accordance with university guidelines, they will be available to students for 30 days. Students who will not be attending lectures are encouraged to contact the instructor for support and reading recommendations for the final exam. Erasmus students must schedule an appointment with the instructor to develop an individual study plan, which will also take into account their country of origin.

Learning assessment procedures

For students attending classes, assessment will be based on a written test covering the content covered during the classes, with three open-ended questions. If the test is successful, a final interview is optional, at the student's discretion. If the test is unsuccessful, the student will be required to take a final interview. For students who do not attend classes, assessment will be conducted through a final interview. Erasmus students must schedule an appointment with the instructor to determine the individual assessment method.

Evaluation criteria

The evaluation will be based on the following criteria: • the depth and breadth of knowledge acquired; • the ability to use language; • the ability to systematically connect the knowledge acquired; • the analytical and argumentative ability, including in solving practical cases.
