Learning outcomes
The subject-matter of this course is the relationship between the protection of the needs of the criminal proceedings and the safeguard of the fundamental rights set forth by the Constitution and the International Conventions.
The clash of this issue is given by the area of the cautionary measures whereby it is possible to detect legislative choices shaped on the specific situation of the defendant.
This course aims to grant a complete knowledge of the regulation of the protection procedures reserved either to the diseased defendant, of the pregnant mothers or of the mothers/fathers of children not older than 3 years (Article No. 32 of the Constitution), of the underage defendant (Article No. 31 of the Constitution) as well as of the legal person which may be charged of liability for administrative violation depending on crime (Article No. 41 of the Constitution), or to detect this re-balance set forth by the legislator amongst the different needs.
Special attention shall be reserved to the analysis of the opinions of the Case Law to assess – by the examination of the awards issued by the merit and legitimacy courts – the material effect of such legislative choices.
