Learning outcomes

This course presents the legal phenomenon as a social phenomenon, underlining, at the same time, the impossibility of intending law as a mere fact of power. This approach is based, to a great degree, on reflections and discussions of key issues:
- Law and action;
- Law and institutions;
- Law and roles;
- Law and opinions.
Such an analysis will introduce to the understanding of law as a social phenomenon instead of a simple conceptual artefact.

Program

The course doesn't consider propaedeutics and it is divided into two parts.

The first focuses on the very social nature of the juridical phenomenon.
This part will analyze the following topics:
- general sociological theories;
- sociological method;
- norms as sociological concept;
- order and entropy;
- juridical action;
- legal sanctions;
- government;
- fundamental rights;
- jurisdiction;
- family;
- role, status and groups;
- culture and juridical order.

The second deals with criminal deviance and social control problems.
This part will analyze the following topics:
- penal positivism;
- predictive policing;
- neuroscience and criminal law.
