Learning objectives

The course in intended to provide students with the knowledge of the fundamental institutions governing criminal proceedings, in the light of the principles enshrined in the Constitution and international conventions on which the current legislation is based.

At the end of the course, the student will be able to analyse and elaborate on the basic legal notions and rules of criminal procedural law, as well to apply them to actual cases, using the appropriate and specific legal jargon, adopting correct lines of reasoning and argument, and formulating autonomous judgments.

Prerequisites and basic notions

To take the exam of this course it is necessary to have taken the exam of Outlines of Criminal Law.

Program

The following topics will be covered during the course:
• procedural models;
• the sources of criminal procedural law;
• subjects;
• the criminal procedural act and invalidity;
• means of proof and means of seeking proof;
• personal and real precautionary measures;
• the phase of the preliminary investigations and the preliminary hearing;
• special proceedings;
• the trial;
• ordinary and extraordinary means of appeal.

Didactic methods

The course consists of lectures, for a total of 30 hours (equal to 5 CFU), during which the principles and rules of the criminal trial will be analyzed, and a laboratory, for a total of 12 hours (equal to 1 CFU), dedicated to the presentation and discussion of practical cases on issues of particular relevance in the concrete development of the process: precautionary measures, hearing, appeals.

Learning assessment procedures

The test takes place in oral form.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

The examination aims to ascertain:
- an understanding of the principles, structure and functioning of the criminal proceedings;
- the use of an appropriate technical-legal language;
- the ability to place institutions on a systematic level and to link knowledge;
- the ability to envisage solutions with respect to practical-operational issues.

Criteria for the composition of the final grade

The final grade is expressed out of thirty and refers to the oral exam taken as a whole.
