Learning objectives

The course is intended to provide the student with the knowledge of the basic notions of the international legal system and of the related technical and terminological instruments.

At the end of the course, the student will be able to elaborate on legal issues concerning the main topics of the subject, in both oral and written forms, using an appropriate and specific vocabulary, reaching independent judgement on actual cases, adopting a proper methodology, based on continuous learning and knowledge updating.

Program

1. International law: general notions, theories on its legal basis, sources. 2. Custom in the DI: general information, particular cases relating to the formation and applicability of a custom, binding customary law (ius congens) 3. Treaties: general information, classification, codification: the Vienna Convention on the Law of Treaties, the procedure for the formation of treaties, the ratification of international treaties in Italy, accession, reservations, interpretative declarations, entry into force, application of treaties, interpretation of treaties. 4. Other sources of international law. The relationship between customary law and the codification agreement. 5. The subjects of international law: the subjectivity of the State, recognition, territorial sovereignty and domestic jurisdiction. 6. International organizations. Classification and composition, organs of international organizations, classification. 7. The individual in the DI General notions, international legal regime referable to the individual 8. Other subjects of DI or presumed such. The people: the principle of self-determination, the Holy See, the Order of Malta, the International Committee of the Red Cross. 9. State responsibility and international wrongdoing: general information, the subjective element of the wrongdoing, the objective element of the wrongdoing, elements of the international wrongdoing: fault and damage, responsibility for lawful facts or acts. 10. Circumstances that exclude the wrongfulness of the behavior. 11. Consequences of the wrongdoing and determination of the injured State. 12. International disputes: notion, prevention, peaceful resolution of disputes 13. The use of force: the prohibition of the use of force, exceptions to the prohibition of the use of force, legitimate defense, the right of intervention 14. The law of international armed conflicts.

Didactic methods

The course takes place mainly through frontal lessons held by the teacher: - 30 hours (5 CFU) of frontal lessons, of an institutional nature, dedicated to the transmission of the fundamental notions of the subject; - 12 hours (1 CFU) of laboratory in remote mode, dedicated to the analysis, from an operational point of view, of specific procedural institutes. The use of the e-learning platform for distance learning is envisaged, essentially for the purpose of integrating the possibilities of real participation of the participants in the course. The lessons, in compliance with the University guidelines, will be held in presence. Students are invited to actively participate in the lessons.

Learning assessment procedures

The exam will be in oral form. The oral exam will consist of three questions.
Three questions will be asked during the interview.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

During the exam, the following will be assessed: 1) the degree of knowledge, by the student, of the institutes being studied; 2) understanding of the main problems posed by international law; 3) language skills; 4) the critical capacity that the student is able to exercise on relevant issues.

Criteria for the composition of the final grade

The final mark is expressed in thirtieths and refers to the test considered as a whole.
