Learning outcomes
The course in Civil Procedure, taught as part of the course of studies to obtain the master's degree in law, is divided into two units with a single final exam. The subject of the first unit are the general principles governing the discipline of the civil proceeding which find their basis in the Constitution and in the general provisions of the First Book of the Code of Civil Procedure. The second unit will focus on the discipline of the process of cognition (processo di cognizione) and on the appeal remedies.
Program
The subject matter of the lessons of the first unit will be the principles and general provisions of the civil proceeding.
The lessons of the second unit will focus on the ordinary process of cognition (processo di cognizione secondo il rito ordinario) of the First Instance and the means of appeal.
The theoretical explanation of the principles and procedural remedies will be accompanied with the analysis of case law and with the help of models of briefs and summons of the civil proceeding.
Examination Methods
Oral examination
The students who will have attended the course may choose to have a midterm written examination immediately after the end of each unit: the written test on the first unit will focus on the general principles; the written test on the second unit will focus on the process of cognition of First Instance. In case of positive result of the written test, the student may, at his or her request, take the oral exam in the exam sessions only on the part of program which was not the subject of midterm written test.
