Learning outcomes

Objectives of the Course
The course aims to provide the basic legal and economic notions applied to the motor sciences.
The course aims to provide the basis of the law and the principles that oversee the national legal system that are then translated into sports law as a function of adaptation. The student will be able to acquire not only legal notions and concepts, but will, through reasoning, understand the founding value and the concrete application of the principles of good faith, fairness and loyalty as implemented and interpreted by ordinary and sport jurisprudence. The juridical concept is finally combined with the philosophical and ethical concept of behavior according to honesty as an imperative principle that dominates the internal sports system.

Program

The following topics will be addressed within the course:
1. Basic principles of law: legal facts, legal documents, legal transaction; the subjective right; legitimate interest; good faith, correctness;
2. The associative juridical subjects;
3. Institutions of law relevant to sports law: non-contractual liability; contractual liability; objective responsibility; concept of fraud; concept of guilt;
4. Principles and sports system: ordinary legal system and sports legal system within the constitutional framework; the subjects of the sporting order;
5. The forms of sporting justice: federal cards: technical justice; disciplinary justice; economic justice; administrative justice. the constraint of justice and ordinary jurisdiction and of the sports judge
6. Federal justice: the organization of federal justice and its principles; the types of federal bodies: the federal prosecutor, the federal commission, the federal appeals commission, the
7. Doping in the state and sporting legal system
8. Sports maketing, globalization and sports convergence;
economic techniques of modern sport
