Learning outcomes

Module: DIRITTO INDUSTRIALE
-------
This module, Industrial Law, is taught in Italian. It covers the classic fields of industrial law, focusing on unfair competition and unfair commercial practices as well as distinctive signs and marks and related agreements.
Time permitting, a brief introduction to patents and copyright will also be given. Reference will also be made to these regimes where pertinent to add a comparative perspective.
The principal procedural rules and remedies in relation to Industrial Law will also be briefly covered.


Module: DIRITTO DELLA CONCORRENZA DELL'UE

Lectures are held every Tuesday.

This course begins with an economic, historical and comparative introduction to competition law. It then turns to a more specific examination of European Union competition law and the principal corresponding legal rules and concepts. Among other themes, the course will also include an introduction to the EU merger control regime. Much of the material will be learned through the study of concrete cases.

1) VANZETTI-DI CATALDO, Manuale di diritto industriale, 6° edizione, 2009, Giuffrè. Il testo va studiato limitatamente alle seguenti parti: parte prima (“la concorrenza sleale”: pagg. 1-141); parte seconda (“i segni distintivi”, pagg. 143-351); parte quarta (“processo e sanzioni”: pagg. 525-563, tranne i paragrafi 5, 8 e 19 relativi alle invenzioni, che non vanno quindi studiati); parte sesta (“le regole di tutela della concorrenza nel codice civile”, pagg. 651-661).
2) DE CRISTOFARO G., La nuova disciplina della pubblicità ingannevole e comparativa: il d. legisl. 2 agosto 2007 n. 145, in Studium Iuris, 2007, fasc. 12, pagg. 1306-1317.
Lo studente dovrà, inoltre, essere aggiornato sulle novità introdotte dalla riforma del 2010 (d. lgs. 13.08.2010 n. 131); esse verranno anche accennate a lezione ogni volta che se ne presenterà l’occasione.
Dovrà altresì conoscere il contenuto della legge sulla pubblicità ingannegole e comparativa (D. LGS. 02.08.2007 N. 145) anche al di là di quanto scritto nel saggio di De Cristofaro.

Themes to be covered include:

- Introduction to the concept of “competition”
- Agreements that restrict competition; prohibition and the possibility of exemption
- The abuse of a dominant position
- Institutions and authorities responsible for the enforcerment of EU competition law
- Normative frameworks governing EU competition law
- The competence of the EU in the area of merger control
- State aid control

TEXTS
i. Students attending the lectures will prepare for the exam on the basis of their class notes and on the basis of materials distributed during the course. However, if they intend to take an oral exam they will prepare by studying the book indicated below (JONES and SUFRIN, 2011, chapters 3-7, chapter 9 and pages 854-860, 875-878 and 906-941).

ii. Students that do not attend the lectures will prepare for the exam on the basis of the following book:
ALISON JONES AND BRENDA SUFRIN, EU Competition Law: Text, Cases and Materials, 4th edition, Oxford University Press, 2011, chapters 3-7, chapter 9 and pages 854-860, 875-878 and 906-941.

LECTURES
The course (lasting 30 hours) will be taught in English. The lectures will analyze the application of the relevant legal rules and the students will be expected to discuss cases decided by the European Commission, the General Court of the EU, and the European Court of Justice.

The exam for the Industrial Law module will be oral, in Italian.


Module: DIRITTO DELLA CONCORRENZA DELL'UE

Students that attend the lectures will take a written examination. The exam questions will be written in English and in Italian. Students may choose to write their answers in English or Italian, as preferred. Students may opt instead to take an oral exam on the basis of the book indicated above (JONES and SUFRIN, 2011, chapters 3-7, chapter 9 and pages 854-860, 875-878 and 906-941).

Students that do not attend the lectures will take an oral exam. Students may choose to take the exam in English or Italian.
