Learning objectives

This course is included in the learning area on Food, Fashion and Cultural Heritage. It analyses the competences of the European Union that are relevant for the fashion industry, highlighting the economic, social and cultural value of “creative industries” in the EU legal order. Specific attention is devoted to the internal competences aimed at creating a common market framework for fashion products, as well as the EU initiatives at the international level in order to address the challenges of the globalisation in the fashion sector.
At the end of the course, the student will acquire the skills to understand, from a practical perspective, the relation between manufacturing, creativity and innovation (not only technological), and the necessary tools to promote the internationalisation of European fashion businesses.
The student will be able to address and resolve actual issues arising from the professional context in which he/she is going to operate, focusing his/her competences on the contractual compliance and the methods of alternative dispute resolution. The student will be able to verify the practical implications of the legal and regulatory framework, as well as to resolve practical cases, in both oral and written forms and also through team-work experiences, written-based exercises and the application of the method of Problem Based Solving (PBS), using an appropriate and specific vocabulary, developing proper reasoning and argumentation and reaching independent judgement. The teaching methodology is instrumental to continuous learning and knowledge updating.

Program

Following a preliminary overview of the main strategies and policy initiatives adoteped by the EU institutions in relation to the fashion sector as a "creative industry" (distance learning, 6 hours - 1 ECTS credit), the following classes of the course (in-person, 30 hours - 5 ECTS credits) will focus as to the internal competences, on the following topics, addressed according to a thematic perspective:
- the internal market, with particular regard to free movement of goods, the freedom of establishment and to provide services;
- intellectual property rights, in particular trademarks and designs, with some references also to copyright;
- competition law, with particular regard to the issue of vertical agreements.
As to the Union's external competences, the main acts adopted in the relations with third States (for example China) will be addressed, taking into account the growing phenomenon of globalisation in the fashion industry.

Didactic methods

The course will be delivered in English, partly through in-person classes (5 ECTS credits, 30 hours) and partly through distance learning (1 ECTS credit, 6 hours).
Classes will be organised according to a practice-oriented approach, combining lectures devoted to the study of the basic notions and legal sources regarding the topics covered in the program with practical seminars that will employ the Problem Based Solving (PBS) methodology. These seminars will consist in group discussions of case studies and simulation games inspired by the practice of the fashion industry, as well as papers to be presented by students attending the classes with regard to selected topics previously agreed upon.
The teaching materials used during classes (slides, legal sources, selected case law) and further readings on specific topics will be made available on the e-learning platform "Moodle".
Lectures will be recorded and made available only to attending students or students who have subscribed to the "Panopto for Workers" programme.
Students facing particular situations of fragility due to conditions of disability or learning disorders (upon consulting the Inclusion and Accessibility service of the University) may agree with the instructor on the use of supporting materials and/or tools.

Learning assessment procedures

For students attending the lectures in-person, the exam consists of two elements:
- paper presented in class as a result of an individual or group work;
- oral exam on the topics assessed during classes.
Attending students can prepare the exam on the notes taken and the teaching materials discussed during classes (provided on the e-learning platform "Moodle").
For non-attending students, the exam consists in an oral interview covering the whole course's program.
Non-attending students shall prepare the exam on the textbook indicated in the “Bibliography (Leganto)” section.
For students who have subscribed to the "Panopto for Workers" programme, the exam consists in an oral interview covering the whole course's program and they can prepare viewing the recorded lectures, and on the notes taken and the teaching materials discussed during classes (provided on the e-learning platform "Moodle").
Erasmus students can choose to take the exam
- according to the same course syllabus and examination methods provided for Italian students (differentiated depending on whether they attend classes or not);
- with a written paper elaborated on selected topics to be agreed with the instructor, which will then be presented and discussed during the final exam.

Evaluation criteria

The exam is aimed at ascertaining, in addition to the required knowledge base, that the students have developed sufficient analytical skills and the ability to apply the knowledge base in practical cases. In particular, the exam is aimed at assessing:
- the level of the acquired knowledge base;
- the use of the appropriate legal terminology;
- the ability of connecting the different topics of the course's program;
- the analytical and arguing skills.

Criteria for the composition of the final grade

The final mark is expressed in thirtieths.
For those students who will have presented a paper during classes, the final mark will be allocated as follows:
- paper presented in class as a result of an individual or group work (70%);
- oral exam on the topics assessed during classes (30%).
For other students (non-attending students or those who have subscribed to the "Panopto for Workers" programme"), the final mark refers to the oral interview as a whole.
