IUS/16 - CRIMINAL PROCEDURE

Learning objectives

The course focuses on the interaction between criminal proceedings’ institutes and the European principles and rules, with special attention to the effects of the criminal judicial cooperation in the Euro-EU area. The class aims at providing students with the necessary assessment tools for the understanding of the process’ dynamics most closely connected with the practice of legal professions in the European and international framework. Students shall also acquire the necessary skills for the operational use of the institutions of criminal judicial cooperation, to examine and resolve - at an advanced level - the legal issues emerging in this area. Students will be also expected to develop the necessary critical-argumentative and communication skills to cope with the legal issues arising in the application area, also as a consequence of the rich and now inevitable regulatory production both in Europe (regulations, directives) and in the domestic system (legislative implementation).

Prerequisites and basic notions

To take the European Criminal Procedure exam, it is required to pass the Criminal Procedure Law exam.

First part:
- ECHR system
- Protection of fundamental rights
- Content of fundamental rights

Second part:
- European Union system
- Judicial and police cooperation: subjects and instruments
- Mutual recognition. Personal freedom and delivery. Researching and gathering evidence
- Ne bis in idem. Conflicts of jurisdiction

Didactic methods

The course consists of lectures (36 hours, 6 CFU).
According with the University guidelines, the lectures will be held in person.

Learning assessment procedures

Oral test on the entire teaching program.
Evaluation is expressed in thirtieths.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

Evaluation criteria:
- the knowledge and level of detail acquired;
- the ability to make systematic connections;
- the attitude to analytical evaluation and argumentative skills;
- possession of the appropriate legal terminology.
