Learning objectives

The course is intended to provide the student with the knowledge of the fundamental institutes that regulate the functioning of the administrative process.

At the end of the course, the student will be able to elaborate on the basic legal notions and rules of administrative procedural law, as well to apply them to actual cases, using the appropriate and specific legal jargon, adopting correct lines of reasoning and argumentation, and formulating autonomous judgments.

Prerequisites and basic notions

Knowledge of the administrative law institutions covered in the Administrative Law courses. Prerequisites: Passing the Administrative Law exam.

Administrative justice: - The concept and various systems of administrative justice. - Evolution and characteristics of the Italian system. The division between ordinary jurisdiction and administrative jurisdiction. - The administrative process and its prerequisites: The administrative judge. The jurisdiction. In particular, exclusive jurisdiction. Competence. The parties to the trial. The individual parties and the cross-examination. The object of judgment. - The conduct of the trial: The establishment of the judgement. Precautionary protection. Special rites. The sentence. The appeals of the sentence. Didactic methods

The teaching methods consist of frontal lessons dedicated to the transmission of basic notions, key categories and fundamental application tools. The lessons constitute an in-depth study of the teaching material uploaded to the e-learning platform and made available from time to time before each lesson. Non-attending students will be able to benefit from the teacher's support in studying updated manuals.

Learning assessment procedures

The oral test is functional to ascertain a critical knowledge of the fundamental characteristics of administrative procedural law as well as the ability to study its evolution through direct access and understanding of the sentences of the TAR and the Council of State.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

The test is aimed at verifying the knowledge of the fundamental notions of administrative procedural law as well as the ability to identify - on the basis of logically correct reasoning - solutions, to be explained using a technically adequate vocabulary, to emerging legal problems when applying the procedural discipline , also in relation to the case law in depth during the course. The evaluation is expressed in thirtieths.

Criteria for the composition of the final grade

The composition of the vote will result from the following criteria: • depth and breadth of knowledge gained; • language skills; • ability to connect knowledge in a systemic way; • analytical and argumentative ability.

Type D and Type F activities

Le attività che consentono l’acquisizione dei crediti riservati alle attività formative a libera scelta dello studente (TAF D) sono le seguenti:

  • Un insegnamento previsto nell’elenco delle attività formative TAF D) allegato al piano didattico del corso di laurea in Servizi Giuridici per impese, amministrazioni e no-profit;
  • Un insegnamento attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza ;
  • Un laboratorio didattico attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
  • Un laboratorio didattico attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche; 
  • Un insegnamento previsto dall’Offerta Formativa di Ateneo, non impartito nell’ambito dei corsi di studi afferenti al Collegio di Giurisprudenza: il riconoscimento dei crediti acquisiti sarà subordinato alla preventiva presentazione di coerenti programmi formativi valutati dalla Commissione istruttoria per la didattica e approvati dal Collegio didattico.
  • Attività formative organizzate dai singoli docenti del Collegio di Giurisprudenza o del Dipartimento di Scienze Giuridiche: previa approvazione del Collegio ad esse verrà attribuito, dopo un’apposita verifica, un credito per ogni 6 ore di frequenza obbligatoria;
  • Attività formative che implicano la partecipazione a convegni o seminari organizzati sotto il “logo” del Dipartimento di Scienze Giuridiche o dell’Ateneo: devono essere preventivamente approvate dal Collegio di Giurisprudenza indicando un docente di riferimento del Collegio di Giurisprudenza ovvero del Dipartimento di Scienze Giuridiche. Un credito per ogni giornata di convegno o di seminario si acquisisce dopo apposita verifica che dimostri l’avvenuta fruizione culturale del tema del convegno o del seminario.

Le attività che consentono l’acquisizione dei crediti riservati alle ulteriori attività formative (TAF F) sono le seguenti:
• Informatica (3 cfu)
• Stage;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche.

Internships are aimed at enabling students to gain direct knowledge of the world of work and to acquire specific professional skills.

Internships are carried out under the responsibility of an individual lecturer, and can be carried out in professional firms, public administration bodies and companies recognised by the University of Verona.

Any CFU credits gained by doing internships will be recognised and recorded by the University in accordance with the relevant University regulations in force (Regolamento d’Ateneo per il riconoscimento dei crediti maturati negli stage universitari).
