Learning outcomes
The course aims at providing students with the tools necessary to analyse the general principles governing the discipline of the civil proceedings which find their basis in the Constitution and in the general provisions of the First Book of the Code of Civil Procedure. The course will enable students to comprehend the regime and the functioning of civil proceedings and means of redress. At the end of the course, students shall have the ability to formulate, in an autonomous and critical way, judgements and elaborated arguments on the main legal questions dealt with in class.

The subject matter of the lessons of the first unit will be the principles and general provisions of the civil proceeding. The lessons of the second unit will focus on the ordinary process of cognition of First Instance and the means of appeal. The theoretical explanation of the principles and procedural remedies will be accompanied with the analysis of case law and with the help of models of briefs and summons of the civil proceeding.
TEACHING METHODS
The lessons, in compliance with the University guidelines, will be held in presence and also accessible remotely, in live streaming via Zoom link. The recording of each lesson will also be published on the moodle page of the course.

Oral examination The students who will have attended the course may choose to sustain a midterm written examination immediately after the end of each unit: the written test on the first module will focus on the general principles; the written test on the second module will focus on the process of cognition of First Instance. Each written test is conducted in 45 minutes on 30 multiple choice questions.. In case of positive result of the written test, the student may, at his or her request, take the oral exam in the exam sessions only on the part of program which was not subject of midterm written examination. The final mark is expressed in thirtieths.
