IUS/02 - COMPARATIVE PRIVATE LAW

Learning objectives

This course is included in the learning area on Food, Fashion and Cultural Heritage. The course provides, with a comparative approach, an illustration of the legal regulation of activities related to the production, marketing and consumption of food and beverages in a transnational context.
In particular, starting from the analysis of market dynamics and of the most recent technological innovations applied to the food sector, the course will explore issues related to production rules, business practices, distribution chains, paying attention to the rules of protection of human and animal health and environmental sustainability. At the end of the course, students will acquire the ability to formulate, autonomously and critically, complex judgments and arguments on the main topics of the course.
At the end of the course, the student will have acquired the ability to face and solve practical problems typical of the professional context in which he/she will work, thus orienting his/her competence to the goal of contractual compliance and to the prevention of judicial conflicts. At the end of the course, the student will also be able to verify the practical and applicative consequences of the theoretical and regulatory framework and to set, in written and oral form (and also through group working, written exercises and the method of Problem Based Solving - PBS), the solution of concrete issues, using the appropriate and specific disciplinary vocabulary, adopting the correct lines of reasoning and argumentation, and formulating autonomous judgments. The teaching method used is functional to the continuous learning and updating of acquired knowledge.

Program

During the course, the different profiles of agricultural law will be presented briefly, choosing comparative points with different countries according to the various topics covered. We will analyze how the rules of the global market contribute to the harmonization of legal systems and in particular in the food sector. Taking a cue from the discipline on geographical indications, the themes of the group papers will be proposed with which the influence of the global system on the comparative method will be highlighted.

• WTO agreements concerning agricultural products and food
• Geographical indications in TRIPs and bilateral agreements
Face-to-face lessons (30 hours)
• National and comparative models on the regulation of land access and use
• National and comparative models on the discipline of agricultural enterprise and agricultural contracts
• National and comparative models on the regulation of supply chain contracts
• National and comparative models to guarantee food safety
• National and comparative models on agro-food quality
• Focus and in-depth analysis: comparison on agri-food law issues regarding agreements with the United Kingdom (PBS)
• Focus and in-depth analysis: discussion on agri-food law issues regarding the agreement with Canada (PBS)
• Focus and in-depth analysis: discussion on agri-food law issues regarding negotiations with Mercosur (PBS)

Didactic methods

The course will be held in Italian language.
At the beginning of the course, further details on the program will be provided via the Moodle platform.
In order to offer the necessary elements to tackle the paper, distance lessons will be made available immediately in which the international discipline of geographical indications will be presented.
Non-attending students are invited to consult the Moodle platform and contact the teacher in case of doubts as well as to check if regulatory changes have occurred.
The course includes a combination of lectures for 30 hours (supported by the use of ppt presentations). Another 6 hours will be recorded and available in advance. From the first lesson, a dynamic teaching model will be promoted which foresees the active participation of students. Group exercises will be organized according to the Problem Based Solving (PBS) method. At the end of the course, the presentation of the in-depth papers and the final discussion are organized.
In the classroom and through the Moodle platform, various debates will be launched to encourage participation and understanding of the topics covered.

To support students, theoretical lessons will be recorded and made available on the Moodle platform.

Learning assessment procedures

For students who will follow the lessons, the verification of learning will be based on two different elements:
Oral exam on the topics covered during the course (50%)
Paper (max 3000 words), presentation of the paper and participation in the activities carried out during the course (50%)
For students who will not attend the lessons, the assessment of learning will take place through a single oral test.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

The evaluation will take place through the following criteria:
- the depth and breadth of the knowledge gained;
- the property of language;
- analytical and argumentative ability;
- the capacity for critical reflection.

Criteria for the composition of the final grade

The final evaluation is expressed in 30ths. The awarding of honors is linked to the following evaluation of the exam: complete control of the discipline, excellent language skills, excellent analytical and argumentative skills and critical reflection on the legislation.
