IUS/20 - PHILOSOPHY OF LAW

Learning outcomes

The course aims to allow the students to develop a critical awareness of the complexity of juridical experience with particular regard to its methodological aspects. For this purpose, in addition to the lessons of the two professors (oriented to analyse the content of Frederick Schauer’s book), there will be some seminars with the presence of other scholars and experts.

Program

In order to help to understand essential issues, the course focuses, in its first part, on the concept of legal rule, on jurisprudential elaboration, on the idea of authority, on the use of analogy, on the common law model.
Then, in its second part, in order to realize how living law really rules specific cases, the course sketches essential theoretical issues about the relationship between facts and rules in the activity of the judge, with special concern to legal interpretation and argumentation.

Examination Methods

The oral examination, based on suggested bibliography, is oriented to evaluate student’s ability to discuss the topics of the course.
The student must demonstrate:
