Learning objectives

The aim of the course is to offer students a general view of the national and international discipline of intellectual property and competition law. Through the analysis of selected juridical cases, lectures also intend to increase students’ capability of recognizing juridical problems related to marketing, communication and advertising, R&D and transfer of technology.

Program

The program intends to address the most relevant legal institutions of industrial and competition law, with a view to providing an exhaustive overview of the rules that regulate corporate communication as well as the rationale underlying them. The theoretical explanation will then be accompanied by a practical approach to the subject, through the presentation of case studies and related discussion of the problems to be resolved in order to set up the company's marketing strategies concerning the exploitation of its intangible assets in a legally correct manner. In summary, the program will focus on the following topics: - Antitrust law - Unfair competition - Unfair commercial practices - Trademark and distinctive signs - Geographical indications - Designs and models - Patent for invention The discipline must be studied on the Civil Code and other relevant laws . The Manual to be used to prepare for the exam is the following: M. Bertani, A. Cogo, Ph. Fabbio, A. Genovese and A. Ottolia, Outlines of industrial law. Competition and intellectual property, Wolters Kluwer, 2024, Parts I to VI.

Learning assessment procedures

The exam consists of a single written test in Italian on the entire programme, structured in 3 open-ended questions on three different parts of the programme. During the written test it will be possible to consult the legal texts, as long as they are not commented and not annotated. The written test lasts 90 minutes. In order to pass the exam, it is to demonstrate that they have studied the textbook indicated in the teaching programme. The score is out of thirty and the minimum score is 18/30. Passing the test implies the registration of the vote.

Evaluation criteria

In the answers to the questions, the knowledge of the discipline and its main interpretative problems, the understanding of the notions learned through the study of the reference textbook and the ownership of the legal language will be evaluated. Criteria for the composition of the final grade

The score is out of thirty and the minimum score is 18/30. Passing the test implies recording the grade. In the event of a particularly brilliant test, the teacher can confer honors
