Learning objectives
The course is intended to illustrate the substantive and procedural law on the subject of liability ex contractu and ex delicto thanks to the analysis of actual cases coming from the classical Roman jurisprudence. It is also aimed at providing the student with the technical and conceptual tools necessary to understand and interpret the current positive law.
At the end of the course, the student will have be able to deal with legal issues in written and oral form through correct lines of reasoning and argumentation; to use an appropriate and specific legal jargon; to formulate independent judgments on actual cases thanks to a method based on continuous learning and knowledge updating.
Prerequisites and basic notions
Romanistic Foundation of Private Law is the preparatory exam for this course.

Contractual liability: sources, regulation, functions
Non-contractual liability: sources, regulation, functions
Special part
Case studies regarding:
- pre-contractual liability;
- 'utilitas contrahentium' and grounds for liability;
- accident (contractual liability);
- medical liability;
- slaves and AI: a comparison of liability models;
- 'actio de pauperie' and damages caused by driverless cars.
The didactic material uploaded on the platform Moodle will be available to students.
Understanding the legal phenomenon of liability is a specific professional skill for employment (GOAL 4). Reflection on the topic from a historical perspective promotes the training of jurists capable of benefiting the institutions of the legal system, in terms of greater effectiveness, liability and transparency (GOAL 16).

Didactic methods
The course combines some frontal lectures regarding the general part, through an active participation of the students, with some lectures concerning the special part, according to the problem based solving (PBS) method (30 h.).
The livestream workshop, based on the learning by doing method, provides students with tools and methods for a written and oral presentation of legal issues (12 h.). The scheduling of workshop hours is agreed with the students at the beginning of the course.
Any conferences and/or seminars of particular interest for the topics covered will be reported from time to time by the teacher during the lessons.
The video recordings of the course lessons will be made available exclusively to the following categories of students, who are kindly invited to contact the teacher:
- students with disabilities, invalidity or DSA, following communication to the teacher by the Inclusion and Accessibility Unit;
- students participating in the PA 110 e lode training project;
- Panopto for workers.
Learning assessment procedures
For attending students the exam will consist in a further oral interview on the entire program, starting with the discussion of a case study to choose from.
By agreement with the lecturer, they could also present a written essay on a specific topic to the class.
For non-attending students the exam will consist in a further oral interview and will focus on the topics in the recommended text.
For ERASMUS students the exam will consist in a written paper, in Italian or English, on the part of the program agreed in advance between the student and the teacher.
Evaluation criteria
The exam’s goal is to test the program knowledge, having regard to the student’s ability to develop a critical reasoning on specific legal issues.
The evaluation criteria are as follow:
- acquisition of knowledge;
- acquisition of critical reasoning skills;
- acquisition of analytical capacity and arguing ability.
Criteria for the composition of the final grade
The final evaluation is expressed in thirtieths (30/30). The evaluation between 18 and 20 corresponds to a sufficient, yet low and basic, knowledge of the contents; the evaluation between 20 and 25 shows a more than sufficient/discreet knowledge of the contents; the evaluation between 25 and 29 shows a good or very good knowledge of the contents together with commendable critical skills. The evaluation between 30 and 30 cum laude corresponds to a very good or excellent knowledge together with high critical, analytical and connection skills.

Italiano. Gli studenti/le studentesse ERASMUS potranno scegliere se sostenere la prova in italiano o in inglese, previo accordo con la docente.
