IUS/17 - CRIMINAL LAW
1° periodo lezioni - GEM dal Oct 1, 2021 al Dec 22, 2021.
The course will provide, principally starting with two critical macro-sectors of criminal law, the conceptual, methodological and cultural basis to understand and study the categories and the general principles, developing the capacity in using correct and specific technical language. At the end of the course students will be able to understand, on the one hand, the emerging and current criminal phenomena in the technological context (i.e. in particular terrorism, cyber-terrorism, cyber attacks and „cyber-war“) and, on the other side, the criminal offences regarding the public adminstraions, identifiyng the application/leading solutions through the most appropriate reasoning and legal arguments.
Introduction: serious and transantional criminal phenomena and criminal law for public administrations.
1. General principles of the Italian Criminal Law, in the european perspective.
2. Criminal offences against the Public Administration:
2.a. general introduction and subjective qualifications (artt. 357 to 360 c.p.);
2.b. criminal offences against public property, functional duties (artt. 314 to 335-bis c.p.);
2.c. criminal offences against public administration committed by private persons (artt. 336, 337, 340, 341-bis, 346, 346-bis, 348, from 353 to 356, 393-bis c.p).
3. Cybercriminality and criminal law for public administrations:
3.a. Criminal phenomena and emergency in the technological context (cyber-attacks, cyber-terrorism, data & Internet governance, cybersecurity & data protection),
3.b. Cybercrime and criminal law for public administrations (the most important cybercrimes, in the broad and in the strict sense, against public administrations or committed by public officials, including illegal access, cyber-computer fraud and privacy enfringements).
The course combines frontal classroom lessons and on-line teaching, in particular: 30 hours (5 CFU) frontal classroom lessons and 6 hours (1 CFU) online teaching.
The frontal classroom lessons will concern all the parts of the program.
The online teaching will concern specific case studies regarding the topics studied during the classroom lessons, following the Problem Based Solving (PBS) method.
Students not attending classes are invited to contact the Professor in order to receive support and useful references for the preparation of the final exam.
Erasmus students must fix an appointment with the Professor in order to select an individual program, taking into consideration also the State of origin.
The materials of the lessons, including ppt presentations, video, scientific works and case studies, will be published on the moodle of the course.

Students attending classes:
1 mid-term written exam, with 3 open questions.
If the mid-term exam is positive: oral examination will be optional, at the choice of the student.
Students not attending classess: oral final exam.
Erasmus students must fix an appointment with the Professor in order to identify the individual valuation method.
The evaluation criteria are the following:
level and depth of study and understanding;
capacity to connect systematically the understanding;
analitycal and arguing ability.
Grades are awarded on a scale from 18 to 30, where 30 is the highest grade and 18 is the lowest grade to pass the exam. In case of an excellent knowledge and a high level of problem-solving capacity, the candidate may earn the highest grade with “cum laude” honor.
