Learning objectives

The objective of the course is to offer to the audience the conceptual tools needed to understand, analyse and deal with the questions arising out cases having an international element. The course, conducted by promoting critical reasoning and interaction in class, aims at providing students with the ability to navigate through the plurality of legal sources governing jurisdiction, choice-of-law and recognition/enforcement of foreign judicial acts/decisions in the Italian legal system.

I. Object, purpose and features of private and procedural international law
- Origin, evolution and purpose of the subject matter
- Legal sources and unification pursued at International and European level
II. International procedural law fundamentals - specific attention will be devoted to Law n. 218/95 and Regulation (EU) No. 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (so called Brussels I bis)
- Allocation of jurisdiction in transnational cases: heads of jurisdiction and choice-of-court agreements
- Coordination of proceedings pending before different national courts: lis alibi pendens
- Mechanism regulating the circulation of decisions: requirement for the recognition and enforcement of foreign decisions.
III. "Choice of law" problem and coordination methods
- Structure and function of choice of law provisions, connecting factors
- Characterization and preliminary questions, renvoi
- Ascertainment and interpretation of foreign law
- Public policy and overriding mandatory provisions
- Overview on the EU choice of law regulations: characteristics and peculiarities of the EU choice of law

Didactic methods

Each class will be based on lectures - devoted to the transmission of key notions and concepts and supported by PowerPoint presentations - and group discussions on real cases. In order to be able to actively participate in class, students will be required to read in advance the decisions that are going to be analyzed. Legal materials, relevant decisions and further readings will be posted on the e-learning platform.

EACHING - METHODS OF DELIVERY
The lessons, in compliance with the University guidelines, will be held in the presence. The video recordings will be made available only to attending students and, upon request, to students who are in particular situations of fragility due to disabilities or learning disabilities as well as to those in isolation due to Covid-19.

Learning assessment procedures

Exam for attending students
Students that have regularly attended classes have the option to take an oral exam or a written test. The written text will be held right after the end of the course and will require students to solve two practical cases involving legal questions and issues dealt with during the course. The highest score for each case-solution will be 15,5 points. The final mark will be expressed in thirtieths. The oral exam, on the other hand, will consist of an oral discussion, aims at verifying the knowledge of the fundamentals of Private and Procedural International Law (as explained in class) in the light of the relevant scholarship and national and European case-law. The final mark will be expressed in thirtieths.


Non-attending students
Non-attending students are required to take an oral exam. The exam will consist of an oral discussion.

Erasmus students
Erasmus students that have regularly attended classes are granted the possibility to write an essay on a topic agreed by the instructor.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

Both the written test and the oral exam aim at verifying the knowledge of the fundamentals of Private and Procedural International Law as dealt with in the textbooks.


The final mark will be expressed in thirtieths.

Criteria for the composition of the final grade

Written test
The grade will be calculated by awarding 9-15,5 points for the solution of each case.
Oral test
Every answer will be graded on a 10 point scale (with 10 point scores being the maximum and 6 point scores the minimum).
In both cases the final grade will be expressed in thirtieths.

Type D and Type F activities

Le attività che consentono l’acquisizione dei crediti riservati alle attività formative a libera scelta dello studente (TAF D) sono le seguenti:
• Un insegnamento previsto nell’elenco delle attività formative (TAF D) allegato al piano didattico del corso di laurea Magistrale in Giurisprudenza;
• Un insegnamento attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche;
• Un insegnamento previsto dall’Offerta Formativa di Ateneo, non impartito nell’ambito dei corsi di studi afferenti al Collegio di Giurisprudenza: il riconoscimento dei crediti acquisiti sarà subordinato alla preventiva presentazione di coerenti programmi formativi valutati dalla Commissione istruttoria per la didattica e approvati dal Collegio didattico.
• Attività formative organizzate dai singoli docenti del Collegio di Giurisprudenza o del Dipartimento di Scienze Giuridiche: previa approvazione del Collegio ad esse verrà attribuito, dopo un’apposita verifica, un credito per ogni 6 ore di frequenza obbligatoria;
• Attività formative che implicano la partecipazione a convegni o seminari organizzati sotto il “logo” del Dipartimento di Scienze Giuridiche o dell’Ateneo: devono essere preventivamente approvate dal Collegio di Giurisprudenza indicando un docente di riferimento del Collegio di Giurisprudenza ovvero del Dipartimento di Scienze Giuridiche. Un credito per ogni giornata di convegno o di seminario si acquisisce dopo apposita verifica che dimostri l’avvenuta fruizione culturale del tema del convegno o del seminario.

Le attività che consentono l’acquisizione dei crediti riservati alle ulteriori attività formative (TAF F) sono le seguenti:
• Informatica (3 cfu)
• Stage;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Collegio di Giurisprudenza;
• Un laboratorio didattico attivato nei Corsi di studi afferenti al Dipartimento di Scienze Giuridiche.

News for students

There you will find information, resources and services useful during your time at the University (Student’s exam record, your study plan on ESSE3, Distance Learning courses, university email account, office forms, administrative procedures, etc.). Language skills

In the Study Plan there is the following indication:
“Knowledge of a foreign language (English, French, German, Spanish) - CLA Certification”.
The expected credits (CFU) are 3 in type “E” activities.

The 3 credits can be acquired in the following ways:
i. dedicated teachings of the Degree Course: passing the examination of one of the foreign language teachings organised in the Degree Course + in-person registration of the credits;
ii. certification at the University Language Centre (CLA – Centro Linguistico di Ateneo): minimum required level B1 (complete examination).
Procedure:
Student – enrollment at the University Language Center (CLA) for taking the tests + passing the tests + enrolment in a special list for credit registration.
University – credit registration (without attendance).
iii. recognition of an external language certification as equivalent (procedure: https://cla.univr.it/it/servizi/riconoscimento-delle-certificazioni-linguistiche-esterne).

Graduation


Internships

Internships are aimed at enabling students to gain direct knowledge of the world of work and to acquire specific professional skills.

Internships are carried out under the responsibility of an individual lecturer, and can be carried out in professional firms, public administration bodies and companies recognised by the University of Verona.

Any CFU credits gained by doing internships will be recognised and recorded by the University in accordance with the relevant University regulations in force (Regolamento d’Ateneo per il riconoscimento dei crediti maturati negli stage universitari).

Student mentoring

Tutoring services are managed by the Department of Law and provide the following types of activities:

  • welcome and orientation (orientation tutoring)
  • support to inclusion and accessibility (specialized tutoring)
  • social media management (orientation tutoring)
  • support to Panopto for Workers project (facilitator tutoring)
  • support to teaching and to thesis drafting (educational tutoring).

During the course of the year, the Quality Assurance body of the Degree Course continuously monitors the tutoring activities provided.

A ‘mentor’ is identified for each student. Mentors are appointed among the members of the faculty who serve in the Quality Assurance body of the Degree Course.
The following categories of mentors are provided:

A) mentor for orientation –at the request of the students entrusted to him/her, the mentor contributes to the structuring of their study plan, as well as to help familiarise with the university environment and with the specific ways of organizing time and methods for studying;

B) mentor for students whose career is not in line with the Course schedule – this mentoring facilitates the completion of the study plan and graduation; responsibility for this is entrusted to the Quality Assurance body of the Degree Course, which takes the necessary organisational measures.

La frequenza non è obbligatoria.

Anche se il regolamento non prevede un obbligo specifico, verifica le indicazioni previste dal singolo docente per ciascun insegnamento o per eventuali laboratori e/o tirocinio.
