Learning objectives
The course aims at allowing students to develop a critical awareness of the complexity of juridical experience with particular regard to its logical and methodological aspects. At the end of the course, students shall have the ability to formulate, in an autonomous and critical way, judgements and elaborated arguments on the main legal questions dealt with in class. Students shall also acquire the argumentative skills required for a correct application of positive law.
Prerequisites and basic notions
The student must have passed the Philosophy of Law examination and have a sound knowledge of positive law in its main outlines.
Program
The course aims to introduce the understanding of crucial issues, focusing in its first part on the concept of rule in law, jurisprudential elaboration, the idea of authority, the use of analogy, and the common law model. In order to understand how the practice of law regulates concrete cases, the course then outlines, in its second part, the relationship between fact and law in the concrete activity of the judge, focusing in particular on legal interpretation and argumentation.

Didactic methods
For students attending lessons, the examination will focus on discussing a short paper that should be between 2,500 and 5,000 characters long (including spaces). The topic of the paper must be chosen from one of the seminars proposed by the lecturer, as indicated in the specific course calendar. During the examination, candidates will be required to link and deepen the seminar's theme to the topics addressed in the course.
For non-attending students, the oral examination will focus on the three texts in the syllabus (the third by choice).

Evaluation criteria
In assessing students, the account will be taken of their knowledge of the texts and, for attending students, of the paper presented, as well as their ability to reflect on the law from theoretical and practical perspectives developed during the course.
During the examination - lasting approximately 15 minutes - the student must demonstrate
- understanding and knowledge;
- ability to make judgements;
- communicative qualities;
- study method and critical sense.
Criteria for the composition of the final grade
The final grade will be composed according to the criteria above (approximately 1/4 for each criterion).
