Learning objectives
The course addresses the rules of execution, a judicial way to enforce unsatisfied rights of creditors: special attention will be given to the following proceedings: “foreclosure” and distribution disputes, “recovery of chattel”, “enforcement through coercive measures”, and “oppositions to enforcement”, as typical remedies. At the end of the course, student shall acquire the ability to comprehend and apply the relevant legal regime.
Prerequisites and basic notions
Preliminary knowledge of the fundamental principles of Italian civil procedural law is recommended.
Program
1. Forced execution in general. - 2. The enforcement order and the order to pay. - 3. Forced expropriation and its types. - 4. Foreclosure in general and its types. - 5. Forced sale and assignment. - 6. The concurrence of creditors in forced expropriation. - 7. The distribution of the proceeds and the distribution disputes. - 8. The executive procedures governed by Titles III and IV of the Third Book of the Italian Code of the Civil Procedure. - 9. The italian contempt of court governed by article 614-bis of the Italian Code of Civil Procedure. - 10. The executive oppositions. - 11. The suspension of the executive process. - 12. The termination of the executive process.

Didactic methods
Lectures dedicated to the analysis of the topics covered by the program and to the examination of particularly significant jurisprudential rulings.
The lessons, in compliance with the University guidelines, will be held in the presence. The video recordings will be available only to attending students and, upon request, to students who are in particular situations of fragility due to conditions of disability or learning disabilities as well as to those in isolation due to Covid-19.
Learning assessment procedures
The exam takes place in written form, by answering a multiple choice test consisting of 30 questions.
For ATTENDING STUDENTS, the exam will focus on the classroom program only. In particular, the topics covered in Chapters VII-VIII-IX-X and XI of the manual will not be examined.
Evaluation criteria
During the exam, the evaluation will focus on: 1) the student's degree of knowledge of the institutes being studied; 2) the student's understanding of the main problems posed by the Italian law on civil enforcement; 3) the critical ability that the student is able to exercise on relevant issues.
Criteria for the composition of the final grade
The final grade is expressed on a 0-30 scale.
