Learning outcomes
This course deals with so-called “territorial governance”, understood as “the overall body of norms that enable the interests with reference to which permitted uses may be regulated to be identified and classified” (cf. Constitutional Court, judgment no. 198 of 28 June 2004).
Adopting a perspective focusing on problem solving, the course will aim to impart fundamental notions and a methodology for understanding construction and town planning law in action, interpreting this area of public law legislation and identifying evolutionary trends within it.

I. Territorial governance as an “area of law” under Article 117(3) of the Constitution.
II. The territorial governance function as the principal function.
III. Functions incidental to the principal function.
III.1 The prescriptive function of territorial compliance and the regulation of ownership rights.
III.2 The management function;
III.3. The safeguarding function;
III.4. The function of substantive regulation of the prescriptive function;
III.5. The control function, and in particular the regulation of planning permission.
IV. The function of reversing violations of town planning law.

Examination Methods
The examination will involve an oral discussion aimed at verifying knowledge – which must be presented using technically appropriate terminology – of the fundamental disciplinary categories in this area of law and the capacity to deploy them in a systematic manner along with the capacity for reasoning and argumentation, and thus to correctly structure solutions to practical problems relating to the subject matter of the programme.
ERASMUS students
ERASMUS students are invited to contact the teacher at the start of the course in order to be set a specific topic to be analysed in greater depth in a course essay. That essay will then be the object of an oral discussion in the examinations scheduled within the academic calendar.
