Learning outcomes
The course aims at identifying the system of regulatory sources concerning the protection of health and safety at work and the different types of liabilities that can occur. After a historical reconstruction, aimed at highlighting the impact of the Constitution and of the EU law, the course will focus on the relationship between EU and national sources, on the one hand, and between the general rule set by art. 2087 c.c. and the special provisions provided by delegated decree 81/2008, on the other. Particular attention will be given to the analysis of the provisions of the H&S-at-Work Act concerning the definition of the actors involved in the company prevention system, the content of safety duties, also in the case of out-sourcing, the multiple typologies of risks that need to be considered by the employer in the risk assessment process.
Examination Methods
