Learning outcomes
As the punishment has got a rehabilitative purpose, pursuant to the Article No. 27, Paragraph No. 3 of the Italian Constitution, this course focuses on analyzing the law institutes of the Penitentiary Law system aimed at making the sanctions treatment of the inmates “individualized”.
Program
The course focuses on these main issues: (i) supranational instructions and constitutional principles concerning the enforcement of punishments; (ii) the judiciary organs concerning the enforcement of punishments (in particular, the surveillance judge and the surveillance court; the penitentiary administration); (iii) the penitentiary treatment, disciplinary procedures and prison security; (iv) the rehabilitative intramural treatment; (v) alternatives measures to jail detention; (vi) the different treatment (in particular, for drug-addicted persons, people with serious diseases, for pregnant women and for mothers, for dangerous persons, for under-age persons); (vii) the surveillance proceedings and the procedures for claims.
Examination Methods
Per gli studenti non frequentanti l’esame consisterà in una prova orale sul programma del corso mentre per gli studenti frequentanti l’esame potrà articolarsi nella predisposizione e discussione di una tesina scritta di approfondimento di un argomento del corso, concordato con il docente.
