IUS/20 - PHILOSOPHY OF LAW

Period

2nd lecture period (2A) dal Feb 13, 2023 al Mar 25, 2023.

Learning objectives

The class considers the theoretical concepts of this discipline and its methods of empirical research. The course has the aim to give to the students the tools they need to understand and use the methodology of the sociological research applied to law.

Prerequisites and basic notions

The student must already possess a good knowledge of positive law.

Program

The class offers a general introduction to the legal phenomenon as social phenomenon, showing at the same time the impossibility to reduce law to power. For this reason the course will analyze come fundamental problems coming from philosophy, history, politics, literature and cinema.
In the special part the attention will be focused on Law & Economics literature, trying to highlight features, potentialities and limits of this research project, oriented to interpret law with the tools of economic analysis.

Bibliography

Visualizza la bibliografia con Leganto, strumento che il Sistema Bibliotecario mette a disposizione per recuperare i testi in programma d'esame in modo semplice e innovativo.

Didactic methods

The first part of the course will present Ferrari's introductory text to the sociology of law, also developing an in-depth study on the legal profession in some Western countries.
In the second part the study on some classical texts (Coase, Calabresi, Manne, etc.) will be accompanied by the analysis of some concrete cases.

Learning assessment procedures

The final exam will be oral. The candidate must show that he has carefully read and studied all the texts: those illustrated in class and those left for personal study.
During the exam (about 15 minutes) the student must show:
- understanding and knowledge;
- ability to make judgements;
- communicative qualities;
- study method.

Students with disabilities or specific learning disorders (SLD), who intend to request the adaptation of the exam, must follow the instructions given HERE

Evaluation criteria

In evaluating the student, his knowledge of the texts (which must be read and studied in all their parts) and his ability to reflect on the law starting from those theoretical perspectives will be taken into consideration.
