IUS/08 - CONSTITUTIONAL LAW

Learning outcomes

The course aims at investigating the theoretical and processual foundations of constitutional justice. The course will provide knowledge and understanding of the legal aspects of the decision-making process relating to constitutional issues. At the end of the course, the student will have both the ability to analyse and manage the decision-making processes that involve examining the questions of constitutionality, and the ability to formulate, in depth, autonomously and with critical awareness also to the changing contexts of reference, opinions and arguments, in written and oral form, concerning cases, questions and juridical cases concerning the questions of constitutionality.

Program

The functions of the Constitutional Court will be examined.
In particular, incidental proceedings
- incidentality;
- notion of judge and judgment;
- notion of relevance;
- subject matter and parameter of the question of legitimacy
- decisions of the Constitutional Court (types and effects)

Examination Methods

For students attending the course, the assessment will consist of active participation in the course, the presentation of cases in the lecture, and a final examination on the topics covered in the lecture.
For non-attending students, the examination will be oral and will include an assessment of theoretical and practical knowledge of the institutions covered in the programme.
