Learning outcomes

The course is considered the natural development of Criminal Law - General Part . The aim of the course is to lead the student to the technical interpretation and implementation of the criminal offences of the special part, also the light of their systematic outline, constitutional principles and supranational sources. Students will receive the theoretical and pratical knowledge in order to understand and analyse case studies, developing the capacity in using the specific technical-legal language and the most appropriate legal arguments.

Program

Introduction: the special part of the penal code
1. Criminal offences against the Public Administration:
1.a. general introduction and subjective qualifications (artt. 357 to 360 c.p.);
1.b. criminal offences against public property, functional duties (artt. 314 to 335-bis c.p.);
1c. criminal offences against public administration committed by private persons (artt. 336, 337, 340, 341-bis, 346, 346-bis, 348, from 353 to 356, 393-bis c.p).
2. Criminal Offences against the person and the human dignity:
2.a. criminal offences against life, limb and indivuals (artt. 575 to 593 c.p.);
2.b. criminal offences equality (artt. 604 bis and 604 ter c.p.);
2.c. criminal offences against personal freedom (artt. 605 to 609-undicies c.p.);
2.d. criminal offences against moral freedom (art. 610, 612 and 612-bis c.p.);
2.e. criminal offences against reputation (brief overview)
3. Criminal offences against Property:
3.a. criminal offences against the Property committed through the use of violence, also aginst the person (artt. 624 to 630; artt. 635, 638)
3.b. criminal offences against the Property committed through fraud and other criminal offences against the Property (artt. 640, 640-bis, 641, 642, 643, 644, 644-bis, 644-ter, 646, 648, 648-bis, 648-ter, 648-ter.1, 648-quater, 649 c.p.).

Teaching methods
The course combines frontal classroom lessons and on-line teaching, in particular: 48 hours (8 CFU) frontal classroom lessons and 6 hours (1 CFU) online teaching.
The frontal classroom lessons will concern all the parts of the program.
The online teaching will concern specific case studies regarding the topics studied during the classroom lessons, in particular about cap. 1, 2 and 3, following the Problem Based Solving (PBS) method.
The materials of the lessons, including ppt presentations, video, scientific works and case studies, will be published on the moodle of the course.
Students not attending classes are invited to contact the Professor in order to receive support and useful references for the preparation of the final exam.
Erasmus students must fix an appointment with the Professor in order to select an individual program, taking into consideration also the State of origin.

Examination Methods

Students attending classes:
2 mid-term written exams (50%+50%), with 3 open questions for each one.
The first mid-term exam will concern: Introduction, cap. 1 and cap. 2-2.a.
The second mid-term exam will concern: cap. 2 (2.b to 2.e) and 3.
2 mid-term exams positive: oral examination will be optional, at the choice of the student. The examination will consist of one question considering the entire program.
1 mid-term exam positive and one negative: oral examination will cover the negative part.
Both mid-term exams negative: oral examination will cover the whole program. The examination will consist of at least one open question for each part of the program, which are of equal importance.
Students attending classes may choose, however, to sit the final oral exam on the entire program. The examination will consist of at least one open question for each part of the program, which are of equal importance.
Students not attending classess: oral final exam on the entire program (100%). The examination will consist of at least one open question for each part of the program, which are of equal importance.
Erasmus students must fix an appointment with the Professor in order to identify the individual valuation method.
The evaluation criteria are the following:
level and depth of study and understanding;
language properties;
capacity to connect systematically the understanding;
analitycal and arguing ability.
Grades are awarded on a scale from 18 to 30, where 30 is the highest grade and 18 is the lowest grade to pass the exam.
In case of an excellent knowledge and a high level of problem-solving capacity, the candidate may earn the highest grade with “cum laude” honor.
The official language is Italian.
